Terrell of the County of Taliaferro and State of Georgia being of perfect mind and memory, do make and ordain this my last Will and Testament in manner and form following, To wit, 1st I give unto my son David M. Terrell one negro boy named Jack, one negro girl named Anna, one negro boy named Ellic, bed set and furniture, one horse supposed to be worth seventy five dollars. 2nd I give unto my son Edward B. Terrell one negro boy named Sam, one negro girl named Sooky, one bed and furniture, one horse supposed to be worth seventy five dollars. 3rd I give unto my daughter Catharine G. Tuggle one negro girl named Louesa, one negro girl named Mariah, one bed and furniture, one horse supposed to be worth seventy five dollars. 4th I give unto my daughter Nancy B. Terrell, one negro girl named Mahala, one negro girl named Isabel, one bed and furniture, one horse supposed to be worth seventy five dollars. 5th I give unto my son Peter O. Terrell one negro boy named Isaac, one negro girl named Matilda, one bed and furniture and one horse supposed to be worth seventy five dollars. 6th I give unto my son Joel H. Terrell, one negro boy named [Edm___?], one negro girl named Antonett; one bed and furniture, one horse supposed to be worth seventy five dollars. 7th I give unto my two grandsons Leonidas D. Mercer and Joel T. Mercer one negro girl named Betty and increase, one negro boy named Henry. 8th If either of the above negroes should die before taken into possession by the legatee or legatees, then such legatee or legatees shall receive a negro or negroes worth as much as the deceased negro or negroes were supposed to be worth, or an equivalent in money - All the reminder of my negroes not given out in this will to be divided equally among my six children, to wit, David, Edward, Katharine, Nancy, Peter and Joel. 9th All my household and kitchen furniture stock and plantation tools &c. not disposed of in this will to be sold at my decease as a credit of twelve months and the money to [be] equally divided among my six children, to wit, David, Edward, Katharine, Nancy, Peter, and Joel. 10th All my landed estate to [be] sold by my executors at twelve months credit, and the money equally divided amongst my five children named above David, Katharine, Nancy, Peter and Joel. 11th But in case of my decease before the said Peter & Joel hath received a common English education, the said Peter and Joel are to receive such education out of the money arising from the sales of my perishable property. 12th I hereby constitute and appoint William Tuggle, David M. Terrell & Edward B. Terrell Executors to this my last will and testament. Terrell Francis Wilkinson Georgia Taliaferro County In person came Francis Wilkinson one of the subscribing witnesses to the last will and testament of Joel H. Terrell late of said County decd & upon Oath saith that this writing contains the last will and testament of the said decd and at the time of the making thereof he was of sound disposing mind and memory, and that he did it freely without compulsion so help me God. Sworn to and subscribed in Chambers this 26th[?] day of September 1837. /s/ Francis Wilkinson Test: Quinea O’Neal Georgia Taliaferro County In open Court came William Mattox and upon Oath says that he saw Joel H. Terrell sign publish & declare the within writing to be and contain his last will and testament and at the time thereof he was of sound mind and memory and that he did it freely without compulsion. Sworn to and subscribed in open Court – this 6th day of November 1837. /s/ Wm. Mattox Test: Quinea O’Neal C.C.O. Georgia Taliaferro County In open Court came Henry Terrell and on oath saith that the name of Charles W. Terrell as subscribed to the within will as a witness is the hand write of the said Charles W. Terrell to the best of his knowledge & belief – Sworn and subscribed in open Court Nov. 6th 1836. /s/ Henry Terrell Test: Quinea O’Neal C.C.O. Georgia Taliaferro County In open Court came William Tuggle one of the Executors named to the last will & testament of Joel H. Terrell decd. and was sworn in open Court as Executor of said will, the will and proceedings ordered to be recorded. November 6th, 1837 Test Quinea O’Neal C.C. O. Recorded Nov. 8th 1837. Georgia Taliaferro County By the Honorable the Justices of the Interior Court of said County sitting for Ordinary purposes – To all to whom these presents shall come, greeting. Know ye, that on the Sixth day of November in the year of our Lord one thousand eight hundred and thirty seven the last will & testament of Joel H. Terrell late of said County deceased, was exhibited in open Court, and in common form of law proved and admitted to record, a copy of which is hereunto annexed; and Administration of the estate real and personal, of said deceased, was granted to William Tuggle one of the Executors in and by said will named and appointed, he having first taken the oath and performed all other requisites required by law, he is by order of said Court, and by virtue of these presents, legally authorized to administer the estate, real & personal, of the said deceased, according to the tenor and effect of the said will and testament and according to law. And he is hereby required to render a true and perfect inventory of all the Estate, both real and personal, of the said deceased, and perfect inventory of all the Estate, both real and personal, of the said deceased, and have the same appraised and returned to this Court according to law, and to render a true and correct account to the said Court, of his actings and doings, yearly, and every year, until his administration is fully completed – Witness the Honorable Buford Bird one of the Justices of the said Court of Ordinary this 6th day of November in the year of our Lord 1837. /s/ Quinea O’Neal Clerk C.O. Additional Comments: Joel Higgins Terrell was born December 20, 1775, Bedford Co., VA, died September 17, 1837, Taliaferro Co., GA, son of Peter and Mary (Wingfield) Terrell. Joel was married twice: (1) to Rachel Chivers, (daughter of Thomas Chivers who d. 1810 Wilkes Co., GA), and (2) to his cousin, Frances “Fanny” Butler, born July 15, 1807, died June 29, 1831, daughter of Edward and Elizabeth (Wingfield) Butler. (Note: proof that “Rachel” was the name of his Chivers wife comes from the inscription on the tombstone of their daughter, Mary W. “Polly” (Terrell) Tuggle, which says, in part: “daughter of J.
