As in default thereof the said court will proceed as to justice may appertain Witness the Honorable Ebenezer Starns judge of said Superior Court This __________day of ______ 1853 [Comment: There is an Ebenezer Starns in the 1850 census in Richmond County. He’s listed a a judge of the superior court.] ------------------------------------------------------------------------------- Georgia Tatnall County [Comment: Hanson Lewis is the son of George Lewis. Frederick Holland is married to Matilda Lewis, sister of Hanson Lewis. So it appears this is a family dispute of some sort.] To the honorable Superior Court for said County. The petition of Frederick Holland showeth that Hanson Lewis of said county has injured and damaged your petitioner in the sum of one thousand dollars by falsely and maliciously saying of and concerning your petitioner on the fourteenth day of October in the Year Eighteen Hundred and Fifty two the following false and malicious words to wit “He swore to a lie and he could prove it” meaning that your petitioner swore to a lie, and that he, the defendant Hanson Lewis could prove it; And your petitioner further avers that the said Hanson Lewis has injured and damaged your petitioner in this the sum of money aforesaid, by falsely and maliciously saying of and concerning your petitioner, and of, concerning and in relation to a certain oath which had been duly and legally administered by a proper authority and by your petitioner taken publicly on the day and year aforesaid, other [Comment: the word looks like “other” but I think it is really “utter”.] the following false and malicious words to wit “He swore to a lie and he could prove it” meaning that your petitioner sworn to a lie and he the said defendant could prove it, and your petitioner says that the aforesaid oath which had been administered to and taken by him, was the oath necessary to be taken in such case and administered to him by the count of ordinary for said county on the occasion of your petitioners appointment and qualifications to the office of administrator on the estate of George Lewis late of said county deceased. Wherefore your petitioner prays process may ____ [Comment: I think the word here is “issue”.] requiring the said Hanson Lewis to be and appear at the next superior count to be held in and for said county there and there to answer your petitioners complaint.
