It is ordered that letters dismission issue to the petitioners aforesaid. It appearing to the Court that Gideon NEWSOME, Admin of Stephen JOHNSON, dec'd applies for letters of dismission and that due publication has been made of such application, and it also appearing that he has fully and fairly administered all the assets of said estate it is ordered the court that Gideon Newsom be and is hereby discharged according to his prayer. Gee, Ordinary Georgia, Jones County Monday January 9, 1860 Charles Macarthy Ordinary citation having been duly issued and published requiring all and singular the next of kin and creditors of James MITCHELL, deceased late of said county to be and appear at this term and show cause if any they could why letters of administration de bonus now should not be granted to William H. MONTFORT and Andrew J. COLBERT upon their giving bond and security in the sum of thirty thousand dollars and that the clerk receive Thomas J. RILEY and Julius H. HOLSEY as their securities on said bond and ordered that the clerk grant to them letters of Administration on said Estate. Power of Attorney - State of Georgia - Taylor County Whereas Andrew J. COLBERT and William H. MONTFORT of said county are about to apply for letters of administration on the estate of James MITCHELL, deceased who died in said county of Jones. Thomas J. RILEY of the county first aforesaid being willing to become the security for said applicants and his administration bond in case of their appointment by said court hereby authorizing Julius H. HOLSEY of the county first aforesaid to execute said bond for me and in my name as security, thereto without restriction as to the amount of such bond the same being fixed by the said Ordinary. MONTFORT and Andrew J. Petition of A.J. Colbert and William H. Montfort, Admin De Bonis now of James Mitchell, dec'd intestate Jones County, departed this life leaving as part of his Estate Nineteen Slaves, all specified in the Inventory returned to the Court. Such slaves should be sold for division amongst the heirs at law (eight in number Negroes aforesaid that they have given due notice of this intention by publication.) W.H. Montfort comes to Court and swears the above application is true. So ordered. Court Adjourned. ORDINARY COURT JUNE TERM 1860 Present Joseph J. Huff, Ordinary June 4, 1860 Petition of James W. CARTER sheweth that W.W. CORBITT resident of said county departed this life on __ day of April 1860 leaving a large Estate both personal and real worth Two Thousand Dollars ($2000) - intestate. Seeks Letters of Administration. So ordered upon his giving Bond and Security of Five Thousand Dollars. pg 101 L.Q.C. McCrary petitions for Letters of Dismission from the Guardianship of Mary Ann POPE, now Mary Ann MULKEY; sheweth she has lately married Charles Mulkey. The said Mulkey has taken all the property of Mary Ann into his possession. Edwards & HOLSEY Petitioner's Atty Petition granted. J.W. Carter, Admin of W.W. Corbitt, shows his estate has considerable stock -- hogs and cattle--being subject to die and depreciate in value, prays to sell hogs and cattle. So ordered. Petition of B.A. NORTHERN, Adm and Martha A. Northern, Admx of William T. Northern late dec'd. Sheweth he died intestate with a tract of land on which he resided at time of death, and also certain other land lying in Cherokee. Lands should be sold to pay debts and for division. So ordered. pg 102 Citation for discharge from Administration of Wright BARNES Estate, has been faithfully administered by Enoch Dukes. So ordered. James W. Carter, Admin of late W.W. Corbitt, under the act of 1838 and 1856 prays the Court appoint 5 discreet persons to set apart to the widow and five children the amount necessary for support and maintenance for 12 months from the death of W.W. Huff, Ordinary Petition of Freeman Walker and C.L. Walker, Exe of Persons Walker show that part of his estate was 500 acres being the place where he resided. Petitions for money and property to be set aside for 12 months support. Court appoints C.F. Fickling, A.J. Colbert, LQC McCrary, William A. Melson, and E.B. Roberson to set apart 12 months support for Eliza W. Miller. ORDINARY COURT SEPTEMBER TERM 1860 Present Joseph J. Huff, Ordinary Petition of John S. Brooks sheweth that David F. SHINE departed this life on 5th day of July 1860 leaving a large estate both real and personal, applies for Administration. [David Shine's widow, Luvenia, was daughter of John S. Brooks] Court granted upon his giving bond of $6,000 and taking prescribed oath. Petition of Catherine Corbitt, widow of W.W. Corbitt dec'd, died intestate and his estate is insolvent, in her own right and as the representative of her children prays that appraisers be appointed to set apart 12 months support and the sum of $100 with household furniture. Petition of Catherine Corbitt for her children (six in number) being considered, ordered that the Negro girl, Louisa (which said Negro girl Louisa I have valued at $700) belonging to the estate of W.W. Corbitt. ORDINARY COURT OCTOBER TERM 1860 Present Joseph J. Huff, Ordinary Petition of H.K. Nixon sheweth that J.F.B. GOODWIN, departed this life on __ day of July 1860 leaving a considerable estate - intestate. Applies for permanent letters of Administration. Having given bond of $1,000 and with S.L. Brewer as Security so issued. pg 112 Petition of Martha T. Lowe, guardian of Jeffersonia S. Brooks, sheweth that her Ward is owned and possessed a certain Negro man by the name of Amos, which said Negro is of a very notorious bad character and petitioner fears that some injury will result to said property ; prays to sell. So ordered. C.L. Walker desires to distribute the estate of Persons Walker amongst lawful distributees. Prays the appointment of 3 or more freeholders to make this distribution. So ordered that Jno Worrel, W. H. Greer, W.J. F. Mitchell, John Searcy, and W.A. Melson distribute estate. Court Adjourned. pg 113 ORDINARY COURT NOVEMBER TERM 1860 Present Joseph J. Huff, Ordinary Petition of John S. Brooks, Admin for David F. Shine sheweth that he departed this life leaving certain slaves all specified in the Inventory returned, and certain lands, requests these be sold to the advantage of the Estate. Oct 29, 1860. So ordered. We, William Allen Williamson, Persons Williamson being over the age of 14 years and being entitled to some property from our Grandfather's Estate Persons Walker, and being under the age of 21 which makes it necessary for the Court of Ordinary to appoint each of us a Guardian, we do hereby select James Williamson our Father as our Guardian. Nov 2, 1860. So ordered upon his giving Bond ($4,000) and taking the oath. Petition of Samuel Montgomery sheweth that he is the Administrator of the Estate of James Montgomery, and that it is to the advantage of the legatees, that Samuel Montgomery resign. Presents George H. Davis as a competent person to fill said office. So ordered. John S. Brooks, Admin for estate of David F. Shine requests permission to sell perishable and personal property. So ordered. pg 115 Petition of David O. Smith, Andrew McCants, Bartley McCrary, James Griffith, Harriet Perry and D.W. Simmons respectfully sheweth that they are creditors of W.W. Corbitt, dec'd. Catherine Corbitt, widow, through her attorneys Grice & Wallace has petitioned for appraiser to set apart to her and her children (seven in number). The Ordinary in Chambers on Sept 17, 1860 did grant this petition and regarding the Negro girl, Louisa. Petitioners seek from Court a Rule Ni Si that Catherine Corbitt show cause on 1st Mon in November why this should not be set aside. Reasons: 1)Catherine Corbitt did not sign said petition 2)Facts were not sworn to by petitioner 3)No proof before the court that W.W. Corbitt was insolvent 4)No order granted by the Ordinary appointing Clerk of Court Assessor to make the valuation and set apart the property that is said to exempt from levy and sale. 5)Clerk did not assess valuation 6)Petitioner proceeded under act of Feb 19, 1856 and the order was passed under the act of 23 Feb 1850. 7)Because petitioner received and passed orders in Chambers took place on same day and same time. 8)Adminstrator nor Creditors were not notified of application of Catherine Corbitt 9)No evidence in Court that either Catherine or Grice & Wallace were Guardians of said children 10)Order rendered contrary to Law and without evidence 11)Because Appraisers have been appointed under the act approved Feb 19, 1856 and assessment made for the support and maintenance of the widow and children for 12 months next ensuring the death of W. W. Corbitt 12)Because the assessment made by the Ordinary is made under the act approved Feb 23, 1850 is two large, that act allowing one hundred dollars for the widow and orphans and not one hundred dollars each. Worth of estate at least $10,000. page 118 Temporary Letters of Administration granted to David Beeland and Vincent Montgomery upon their giving Bond of $20,000 with James H. Edwards and James T. Harmon as Security. Court adjourned. ORDINARY COURT DECEMBER TERM 1860 Present Joseph J. Huff, Ordinary Petition of Susan M. DUNCAN and James M. Duncan sheweth that James DUNCAN departed this life 15th Nov 1860, owner of a large valuable real and personal estate. Prior to this time he made his will, appointing the petitioners his Executors. Prays probate in common form Dec 6, 1860. [Susan M. is wife; James M is son] The will of James Duncan being produced and witnesses to same: Wesley H. Jenkins, Jesse Stallings, and James T. May duly sworn testify to the will. pg 119 Ordered that the will be admitted to record as satisfactory proven in Common form and the Executrix, Susan M. and Exec, James M. have leave to qualify. Petition of William G. BOOTH respectfully sheweth that John FULTON departed this life __day of ___ year 1857, possessing a large estate and that Letters of Administration were duly granted to ____ of the _____County of Alabama, it being the county and state wherein the deceased resided at the time of his death. Also in possession of land in Taylor County. As Administrator is a foreigner to Georgia, petitioner prays himself be appointed to sell said real estate. William G. Booth So ordered. Court Adjourned. pg 220 ORDINARY COURT JANUARY TERM 1861 Present Joseph J. Huff, Ordinary Upon application of David Beeland and Vincent Montgomery Admin of Martha E. Shine's estate, appoint appraisers: Bryant Ingram, Benjamin Beeland, Samuel Duke, C.B. Dixon, Gideon Newsome. Petition of Sarah S. and Mary C.E. McCants, minor children of George R. McCants, recently deceased sheweth that they are over 14 years of age and they desire a guardian be appointed, their friend and relative, J.C. McCants, to take charge of their property. Hereby appointed upon his giving bond $7600 and taking oath. There being no objection filed, David Beeland and Vincent Montgomery issued permanent letters of Administration on Martha E. DAVIS, Admin of James Montgomery, dec'd shows he departed this life leaving as part of his estate one tract of land No 183 in 14th district of originally Muscogee, now Taylor County that such land is wild and uncultivated, and requires the proceeds of the sale of land to purchase a Homestead for the minor heirs of said Estate. Huff, Ordinary Notice having been run, James T. Harmon, Clerk of S.P. Court is hereby appointed Administrator of John BIAS, Estate, late of Taylor Co. Petition of James T. Harmon to sell perishable property of the estate of John Bias. Granted. Petition of Amos JOHNSON, Guardian for minor children of Jackson TAUNTON, sheweth it would be in their interest to sell their interest in Lot of land No 213 in 15th Dist of Sumter Co. Also No 116 in 28 Dist in 3rd Section in Cherokee, GA. So ordered Nov 4, 1861 Petition of Mary STURDIVANT, Admx, shows it would be in the best interest of the Estate to keep together the property. Granted leave to work the same for benefit of the Estate, subject to the direction of the court. Petition of James HARMON for appraisers to set apart for widow and children of John BIAS Estate.
