States that Sarah Bryant is wasting the effects of said Estate and disposing of them contrary to law therefore your petitioner subject to great loss. Whereas complaint has been made to this Court by Anderson RUCKER, a Freedwoman, as next friend of Ned PALMER, a Freed orphan minor, that they have mistreated Ned; have not furnished him with clothing and other obligations of indenture. Davenport, Agt Bureau R.F & A L for Taylor County Petition of Bartley McCRARY, referring to orders issued June Term of court on Guardianship of certain minors (John B., Henry, and Sarah Jane McCANTS). They are now 14 and have chosen him as Guardian. Tenders G.F. McCRARY, and J.A. McCANTS as Securities on his Bond - $12,000. Former Guardian of Henry, LQC McCRARY, and Jeremiah A. McCANTS, former guardian of John B. be discharged when they provide proper vouchers. It appearing to the Court that Sallie RILEY and her two children, William and Tim were bound out contrary to orders by James T. Harmon, Agt Bureau R.F & A L for Taylor County Present Agent, J.B. Davenport, has annulled said binding out on the part of said Bureau. Court ordered Indenture null and void. pg 243 At last October term of court Freed minors, Tom GRIFFITH, Henry GRIFFITH, Susanna GRIFFITH, and Amanda GRIFFITH, were bound out to W.H. Griffith. Both parties have become dissatisfied with the binding and ask it be rescinded. Present Agent, J.B. Davenport has consented. W.H. Griffith to withold $12 from any sum owed to said freed minors (they having first created the dissatisfaction) and $2 for Court fees for rescinding the Order. Isabel MANGHAM (Freedwoman) desiring that her minor son, Frank DANIEL, who was bound to James W. DANIEL, at the last Sept term of court, desired his release from said binding out and James W. SAYLOR, Exr of Esaia Saylor, asks leave to sell all the Lands of said de'c under the Will. Granted. Huff, Ordinary pg 247 Petition of James HARMON shows that Simon JONES, Richard Jones, Matilda Jones, Nancy Jones, Linnie Anne Jones, minor children of John Jones late of said county, dec'd have considerable estate coming to them from the Estate of John Jones, dec'd and that it is the wish of Nancy Jones,(having waived her right of Guardianhip) the mother of said minor children. Guardianship to be given to said James Harmon. Petition of Willis HOBBS, Temp Guardian of Mary W. HUNTER, minor child of Wilie. E. Hutner, dec'd seeks permanent Letters. Court so orders. Willis Hobbs shows it is absolutely necessary that an advance of $60 be made to him for his War to defray her necessary travelling and other expense. Granted. Petition of D.A.J. WILLIS, Adm of Martin W. WEBSTER, dec'd shows in his possession a fi fa on Eli B. ROGERS & W.J. LAWSON, the principal amount $27) obtained in Justice's Court in an dfor the 853rd Dist GM of said count at Sept term of 1866. There is no probability of collecting said Fi Fa at any time soon, petitions Court to allow him to sell said Fi Fa. Granted. Petition of D.A. J. Willis, shows he is ready to come to a settlement and make a final return. Asks for Letters of Dismission. Newsome Petition of Kizzy POSEY, sheweth she is the widow of William POSEY, dec'd who left an estate worth about $300 as will be seen by reference to a Bill of Inventory and Appraisement filed in Ordinary's Office 5th Nov 1866. Petitioner is old and unable to work, asks for whole estate to be set apart to her. Court reviewed Inventory worth $271.50. Ordered Kizzy be allowed to possess the said property and do as she sees fit. To all and Singular Sheriffs: Whereas A.H. RILEY, has been appointed Adm of estate of James J. MITCHELL, and has failed to make a return for the year 1865 and 1866. Demands he appear in next court to render statement of accounts. Paper served by Malachi Jones, Deputy Sheriff Feb 22, 1867 Certified paper March 9, 1867. "Mother of his girl living at Green King's White Water, notify the motehr to take the child by Dr. N's consent. (Signature too faint to read) pg 251 This indenture made this 22nd day of Feb, 1867 between Sophronia WEBB, Freedwoman for her minor daughters, Ella and Mary being about 8 and 5 years respectively on the one part and Sidney S. TAYLOR on the other part, consenting to bind as Apprentices in the trade or craft of house servant or laborer until the age of 18. Agreed with terms and to give $100 at end of indenture. Davenport, Agt Bureau R.F & A L for Taylor County pg 253 Petition of Willis McLENDON, shewest that Harriet McLENDON, a freedwoman aged 36 years is an idiot-almost entirely or and does not have means of support for herself, or her daughter, Sukey, aged 7. Harriet to be bound for her natural life, and Sukey until the age of 18. Agreed with terms and to give $50 at end of indenture. Willis McLendon (appears to be actual signature) Approved by James B. Davenport, Agt Bureau R.F & A L for Taylor County pg 255 Petition of James Harmon indicates previous publication in Columbus Enquirer for Guardianship of Simon JONES, Richard Jones, Matilda Jones, Nancy Jones, Linnie Anne Jones, orphan minors of John Jones late fo said county. Granted. It appearing to the Court that the supposed Will of Dolly JOINER having been unadvised and admitted to record, and it further appearing that said pretended will is not a legal one, among others, upon the ground that it was not attested to by a lawful number of witnesses. And it further appearing that Willis HOBBS, qualified as Executor upon said pretended will. And the estate of said dec'd having been left intestate, and the said Willis HOBBS having refused to qualify as Administrator and refused to give Bond and Security; ordered that said Willis HOBBS turn over all and any effects he may have in his possession belonging to said estate to John E. JOINER. Upon giving Bond and Security, John Joiner will be given Letters of Administration. ORDINARY COURT JUNE TERM 1867 Present Joseph J. Huff, Ordinary Petition of B.F. Newsome shows that Fannie BAILEY, a Freed minor girl was bound out to him by said Court. See July Term. pg 259 ORDINARY COURT JULY TERM 1867 Present Joseph J. Huff, Ordinary Petition of B.F. NEWSOME shows that Fannie BAILEY, a freed minor girl was bound out to him March 1867, and June, 1867, the Mother of said freed girl came and took minor from under his custody. Now prays the Court grant order Rescinding said artilce of Indenture. B.F. Newsome released from Indenture. Petition of John S. MURRAY, Adm of Anthony R. MURRAY, dec'd shows he has completed his Administration and requests Letters of Dismission. Petition of Harriet BREEDLOVE shows she has fully administered the estate of Leonard Breedlove, settled with creditors, and requests Letters of Dismission. Petition of Lavinia SHINE, shows that her husband, David F. SHINE departed this life leaving a considerable Estate, and besides other heirs a minor one, David J.T. SHINE who has no Guardian to care for his person or property. Requests Letters of Guardianship as his Natural guardian. So ordered. pg 261 ORDINARY COURT AUGUST TERM 1867 Present Joseph J. Huff, Ordinary No business. Adjourned until September. ORDINARY COURT SEPTEMBER TERM 1867 Present Joseph J. Huff, Ordinary Petition of Amanda LITTLE, shows that J.C. LITTLE, late of said county, died intestate leaving considerable Estate. Shows she is the Widow and requests Letters of Administration. 12 Aug 1867. Granted. It appearing to the Court that it would be in the best interest of the Wards of Abajail FORSHEE, Guardian of minor children, Francie, John, Sarah A, Daniel and Elisha to appropriate $50 out of the principal of the Estate for their support. Petition of D.A.J. WILLIS, requests Letters of Dismission after publication from the Admin of Estate of Martin WEBSTER. Granted. Caveat in the matter of the Return of Joshua NEWSOME, Admin of estate of Martha Newsom, dec'd. And now in Chambers comes Atty W.S. Wallace, for heirs at law, except Joshua Newsome. Return made 8 July 1867 by Joshaus Newsome, say the sum should not be admitted to record. Voucher No 10 should not be allowed as A.B. Newsome did not oversee or stay on plantation the year of 1861. Voucher No 11 is too large for the services rendered and the teams of Negroes, by which the hauling was done belonged to the Estate. Voucher No 17 is too large for the Services rendered and further that the gin and screw used was the property of the Estate or such as the Estate had the right to use; the cotton should have been sold in the seed at the Sale when it would have brought a large price and when it was advertised to be sold. Because the cotton was sold for less than its market value; and further because the meding is an overcharge and should have been paid by the purchaser. By consent of parties the Clerk of this Court is directed to make out a certified copy of the above and file with the Clerk of the Superior Court together with the said Annual Return and accompanying vouchers of Joshua Newsome. pg 263 Petition of L.B. MOSELY shows that Martha Ann MOSELY, a Freed minor orphan girl aged 12 years and former slave of Mrs. Icey FOWLER, has no parents and is without support. Requests she be bound to him until she is 18. RHODES set apart 12 months support. pg 264 Petition of (blank) AMERSON sheweth that Thomas AMERSON, late of said county, died leaving a will, naming him as Executors. Witnesses John D. Ordered that Executors qualify. pg 265 Petition of Eliza ROGERS, widow shows that she has a number of children she is unable to support; requests bindig out Julia Francis, her daughter aged 9 and Wiliam Douglas, her son age 7 years to Cornelius BACHELOR. Eliza x Rogers Cornelius x Bachelor Indenture made 7th Sept 1867. BEELAND, Adm of Alfred BIRD, dec'd shows the whole Estate is invested in Notes, and that he is unwilling to sue said notes and that he is unwilling due to cost in said cases. He further shows that it would be to the interest of the Estate not so sue said Notes, and asks Court to allow him to manage and dispose of said paers as he may thing best for the Estate. So ordered. ORDINARY COURT OCTOBER TERM 1867 Present Joseph J. Huff, Ordinary pg 267 Petition of Mrs. Amanda LITTLE, widow of J.C. LITTLE, dec'd for permanent Letters of Administration. Granted. Petition of S.S. McKINNEY to sell the real estate of Joshua McKINNEY and Seaborn L. DEAN dec'd. So ordered. Petition of LQC McCRARY and Wiley McCRARY shows that Bartley McCRARY lately died leaving his last Will and Testament in which your petitioners were named Executors. The will of Bartley McCRARY produced in court with affadavits by witnesses. Ordered admitted to record. ORDINARY COURT NOVEMBER TERM 1867 Present Joseph J. Huff, Ordinary Robert P. HAYS shows he is one of the Securities of J. McCANTS, dec'd and that he is old and infirm and that justice to his family demands he should not entangel himself in matters out of which future litigation may spring and prove expensive and possibly ruinous to himself or family. He further states he is dissatified with the general Administration of the Estate and by the relatively young age of the Adminstrator, that he may involve him in consideral litigation and loss. LEE, late of said county dec'd, shows the Estate is worth less than $300. She is poor and unable to support herself and her children unless said Estate is set apart to their use. Ordered by court. pg 274 It appearing to the court that Wiley McCrary and LQC McCrary, Exec of Bartley McCrary advertised and held a public sale Dec 1867, but were unable to sell a certain stallion and now ask leave for a private sale. Officers of Court vs John Bateman Court fees on examining Books of Record and making out Abstracts of same. Judgement for plantiff $1.25 pg 280 ORDINARY COURT MARCH TERM 1868 Present Joseph J. Huff, Ordinary Petition of LCQ McCrary shows he is one of the securities on the bond of Henry B. McCrary as Admin on esate of Andrew McCants. Shows the county is in an unsettled condition and that its laws have been made subordinate to the will of a military Dictator whose orders are mercilessly enforced by the bayonet though they may ruin helpless widows and defendant orphans. Notes that Admin has not for a number of years made any return to the Court. Petitioner fears his Security is in danger and requests that he be released from his bond. Lucius QC McCrary vs. Henry B. McCrary Adm on Estate of Andrew McCants dec'd. Appears to Court that his allegations are true, and he is discharged. Henry B. James Russ, Ordinary pg 292 Know all men by the presents of James D. Russ, as principal and Elam B. WATERS, Robert SCANDRETT, and Hugh ROSS as Sureties, are held and firmly bound to Rufus B. BULLOCK, Governor and Commander-in-chief of the Army and Navy of the said State and of the Militia thereof, for the time being and his succession in office in the sum of $1,000 to be paid to the said Rufus B. And petitioner further shows that she has purchased a milch cow and calf for the benefit of said minor children which must be paid for out of the Estate. The petition is read and A. Hill testified that he was acquainted with the condition of said minor children, and also that the facts set forth in the foregoing petition are true and that the purchase of said cow would be pro tants, a judicious investment of said minor's Estate. [1870 census living with daughter, Polly Hortman widow of Henry Hortman] Whereas it appears that it was the rule of the Inferior Court to allow $100 to the clerk for extra services, ordered that the same amount be appropriated and that a special tax be levied for same and other claims of a like nature.
