Upon hearing of the cutisian in the cause it is ordered that the same be dismissed at the cost of the said John Hudson. A.J. Colbert vs James Williamson Rule Nisi to shew cause It appearing to the court that James Williamson, Justice of peace, in and for said county has collected the money in the above cause and has failed to pay out the same. It is therefor ordered upon motion by the court that said Williams shew cause immediately why he should not pay out the same. Cook & Montfort I acknowledge due and legal service on the within served. James Williamson Now at this term comes James Williamson & for answer says to the above rule say that two attachments or in favor of A.J. Colbert vs John Drake and one in favor of Theophilis McGee vs John Drake the attachments in favor of A.J. Colbert – first levied on said property and the money arising from the sale aforesaid property is now in my hands, May 17, 1852. It is upon motion ordered by this court that the said James Williams pay out a sufficient amount of the money now in his hands arising from the sale of said John Duke’s property to A.J. Colbert to satisfy his said attachment and upon his failure so to do an attachment issue for on temp. Cook & Montfort Orders that Gideon Bland, James M Hardings and John A. Hamilton who served as bailiffs for one day as Bailiffs at this term be each allowed and paid the sum of one dollar out of the county funds and John M. Hobbs, ten dollars for the use of his house as a courtroom. Pg 8 It appearing to the court that the Sheriff has expended the sum of One dollar and fifty cents in arranging the Court Room for the holding of the Court and also that the sum of two dollars was agreed to be paid to John B. Arnold for the use of his room for the Grand Jury it is ordered that the Sheriff be paid the sum of ten dollars and fifty cents out of the county funds to cover said items. State v s G.B. Cason Assault with intent to Murder It appearing to the court that the said Green B. Cason having given his recognizance for his appearance at this term of the Court from a Warrant filed by a Justice of the peace as aforesaid and there not being any true bill against the said Cason, it is upon motion ordered he be discharged from said recognition and the same be hereafter void. Cook & Montfort Plff Atty The Grand Jurors sworn chosen and selected for the county of Taylor beg leave to submit the following General presentations. We take great pleasure that at the present term of the Court there has been no bills of indictment which fact in our opinion speaks well for the morality, good order and peace of our new County. We recommend that the Inferior Court do assess a Tax of 50% on the state tax to be levied and collected for county purposes. We recommend to the Inferior Court the opening he Road straight from the Residence of H.H. Long to straight at present occupied by ? Rail Road hands and that all obstruction be removed out of said road across he land of J.W. Mitchell when the old Road formerly ran. We suggest to the Inferior Court that steps be taken as soon as it can be done consistence with the interest of the county to have the necessary public buildings erected. In taking leave of His Honor the Judge presiding we tender him our thanks for his courtesy to this body and best respects to the solicitor for his attention and kindness to this body while in session. Greet For plaintiff the sum of $91.20 Isaac Mulkey, Foreman John Hamilton and James Hardridge having each served one day during the present term as bailiffs of this court, it is ordered on motion that they be paid the sum of $1 each out of any money in the county treasurer. The State vs Green Joiner Murder In open court this day came Andrew Elkins, Celia Elkins and Jane Elkins witness as for the state in above stated precentment and acknowledge themselves held and bound unto Howell Cobb, Gov of the state of Georgia and his successor in office in the sum of $500 each conditions to be void in the event they shall not depart hence without leave of the court but shall attend the court from day to day at ten that may be examined as witness in the above stated case. The State vs Andrew Elkins Bond to keep the peace No prosecutor appearing at the present term in the above stated case, it is ordered that Andrew Elkins, Jeremiah Wilchar, A.S. Wiley, John Turner, Gideon Bland, Henry Joiner be exonerated from further liability on the foregoing bond and that the said Andrew Elkins be discharged from further custody on his paying all cost which have occurred on said case. James M. Hardridge having served one day in addition to the day before allowed at this term as Bailiff – paid $1.00 It is ordered that James T. Bartlett be paid the sum o $10 out of county treasurer for the cost of the house used as Court Room at this present term of court Gideon Bland having served 2 days as Bailiff of the Grand Jury, it is ordered be paid $2.00 To John M. The condition of above obligation is such whereas the above bound Andrew Elkins has his day been arrested under and for virtue of a bench warrant against him for the offence of a misdemeanor now if the said Andrew Elkins shall personally appear at the next term of this court from day to day and from term to term thereof to answer for said his misdemeanor then this recognizance to be void also to remain in full force and virtue. The State vs Levi Jones Misdemeanor It appearing to the court that Levi Jones has given bond and security for his appearance at this court to answer in the above named action and having appeared and being now in court said as no true bill has been found by the Grand Jury and as no prosecutor has appeared on motion it is therefore ordered that he be suffered to go at large and the said bail be void the security be released from all further responsibility in said case. John Joiner Alfred Iverson, J S Court Taylor County presents unto NOV TERM 1852 We the grand jurors sworn, chosen and selected for the county of Taylor beg leave to make the following presentments to wit: We have examined the book of the Clerks of the Superior and Inferior Courts and find them neatly kept. The County Treasure not being present and not having his books at hand, we can give no accurate statement of the finances of the county. We find upon inquiring that the roads of the county are very bad, condition and would recommend to those Pg22 Having cognizance of the same to have them put in better condition. We find that the laws and journals of the last legislature have not reached our county as yet . we are in apprised of the cause of the issued delay in this matter but are disposed in some measure to hold the Executive Accountable for this unheard of tardiness. We are paused to observe so many notations of the laws of our county and would recommend to all good citizens to have their aid in affecting so far as by in these presence a reformation in the morals of the citizens of our county. We tender our thanks to his Honor Judge Iverson for the very able and dignified manner in which he has discharged the duties of his responsible station. We also tender our solicitor general Jack Brown, our thanks for the untiring energy which he has evinced in his courteous attention to this body.
