LDS Microfilm 0321091 Inferior Court Minutes Taylor County Feb 19, 1852 Inferior Court in Chambers, present their honors: Jeremiah Wilchar, Hiram Drane, T.J. Riley, John Sturdivant and Isaace Mulkey on motion appointed Judge Riley Chairman of the court then proceeded to locate and name the county site on motion their honors agreed that the seat should be Butler in honor of notorious Butler family to be located at or near the fifty mile [Wolfpen] station on the Muscogee Railroad in Taylor County. They proceeded to nominate as County Treasurer on motion W.A. Skellie to fill the said office, and S[Serreno].H. Dwight was appointed to take the Census. They then proceeded to determine the proper time to sell the lots appropriated for the site heretofore named which will take place on the twenty fifth day of March 1852 sale to take place at said county site. Notice to be given in the Columbus Inquirer, Georgia Telegraph, Southwest Georgian and Southern Democrat. The court then proceeded to locate Militia Districts appropriate for county purposes which were determined as follows Prattsburg District (Number 737 GM commencing at Prattsburg and running with the county line to the twelve mile post on the Wire Road then with said county line to Patsiliga Creek to the original District line and then with the old Militia District to the county line thence to the beginning. Halls District (Number 743 GM) to remain as it originally stood. Reynolds District (Number 741 GM) bounded as follows commencing at the south east corner of lot No 123 in the 13th District of originally Muscogee now Taylor County and run due North to Patsiliga Creek then down said Creek to the Flint River thence down said River to County line then with the county line to the beginning. Butler District (Number 757 GM) bounded as follows, commencing at the south east corner of lot 123 of original survey 13th Dist and running with the county line to White Water, then up White Water to Browns' Bridge then due North to Patsiliga Creek, Thence to the corner of the Militia District between Prattsburg and Holt's, thence up said line to the Wire Road thence with the Wire Road to McCrary's Bridge on Patsiliga then with said Creek to the Reynolds district corner on said Patsiliga then on due south to the beginning Cedar Creek District No 1071 GM to commence Turner's Bridge thence up said creek Jamison's Ford then with the Tazewell Road to White Water at Brown's bridge Then down White Water to the Burnt bridge then with the county line to the beginning. White Water District Number 853 commencing at Jemison's Ford on Cedar Creek and running to Brown's Bridge on White Water then due North to Patsiliga Creek then up said Creek to the Talbot line then with the Talbot line to the corner of said county then along the county line to Cedar Creek thence down said Creek to the commencement. The court then proceeded to order an election for Justices of the peace and constables for the several districts to take place on the second Saturday in March at the following places for Butler District at the Town of Butler for Cedar Creel District at Y.S. On motion it was agreed that John Sturdivant contract or purchase the necessary blank books for the office of the clerk of the Superior court and the office of clerk of Inferior court and for the office of the ordinary and the office of the county treasurer. The court then proceeded to appoint James T. Harmon, Henry Joiner, James B. Hamilton reviewer of a road from the house of James T. Harmon's by way of Lowe's Bridge on White Water Creek to mark out said road on the best and nearest way and report to said court The court also appointed Jonathan Stewart, George Hays and Lewis Hill to review and mark out a road from J. On motion it is hereby ordered that William Hurst, R.C. Bailey, and John Herricks apointed reviewrs of a road from Butler to intersect the old Federal Road near the west line of the 12th land district; and report to court. And it is further ordered that J. Parker, Jackson Colbert and H.H. Mangham and Thomas Wilson appointed reviewers of a road Butler to Carsonville by way of McCant's . Also ordered that Jeremiah McCants, C.Y. Perry, Thomas Wilson appointed reviewers of a road from McCant's Mills to Prattsburg. Also ordered that the lots comprising the county site be drafter or platted and printed before the day of sale and that his honor Judge Mulkey attend to contracting for the printing of same. Ordered that Henry Millirons have the contract of clearing and heaping the undergrowth of the streets of Butler at $14.00 T.J. Riley, H. Drane, J. Sturdivant. Court in Chambers. Harmon's to Butler and do hereby declare the same as a public road as reported by said reviewers. The court then proceded to commission A.M. Rhodes, Receiver of Tax Returns and then with the assistance of the Sheriff and clerk of Superior Court drawed thirty six Grand Jury and forty eight petit jurors. The Court then authorized Judge Mulkey to engage the printing of one hundred bonds of sale for the use of the court in giving to purchasers of town lots and two hundred blank notes. The court then proceeded to take a deed from Andrew McCants, John T. Gray, John Sturdivant, and (blank) Covington to a certain tract or parcel of land designated in said deed the said parcel of land to locate the court house on and also a deed for a certain parcel of land for the same purposes as the above from John L. Wm Chew? 100 SPECIFICATIONS OF A COURT HOUSE AT BUTLER Brick. The house to 60 feet long and 44 feet wide two stories high. The first story to be ten feet n the clear. The second story to be fourteen in the clear the top of first floor to be three feet from the ground. The foundation wall to be 2 1/2 brick thick. The first story walls 2 brick thick the 2nd story 1 1/2 walls to be nine inches thick. The footings to foundation walls to be 9 inches broader than the thickness of the walls to be drawn in with the first three courses to the same thickness as the walls. There must also be a projecting water table at the height of the lower floor extending around the building. The house must also have four chimneys extending to a proper height above the roof with eight fire places the hearth laid with brick. PLASTERING. The whole of the interior of the building must be plastered twoo good coats well white washed all of the materials used in the brick work and plastering must be of good quality and all the brick exposed to the weather must be good hard burned weather proof brick and laid in good lime mortar. CARPENTERS WORK. The joist in the first and 2nd floor to be 12 inches wide and three inches thick the joist in the ceiling of the upper story to be ten inches wide and 2 1/2 inches thick. All of the joist to placed not more than 2 feet from center to center. The roof to be self supporting with strong beams being post street braces prinicpal rafters Purlines and Jack rafters as seen in plan with strong Iron bolts. The beams to be anchored with at the ends. The roof to be a hopped roof showing a hansom cornice projecting 14 inches extending entirely and the building with a frieze 2 fett wide below it. The rafters must 2 1/2 inches thick by 5 inches wide placed 2 feet apart and shathed and shingled with good heart pine shingles 5/8th of one inch thick. And the first story to divided into four room and two cross passages as per plan. Each Room to have a door with plain framed and casings also a good mantel and the room and passages to have a strong plain base to receive the plastering said first story to have four outside doors with side lights and transom the intablations, supported, each by 2 turned columns The doors to be double as two fold and to be panneled under the side lights and all respects neatly finished. Said first story must also have sixteen windows of 24 lights each 10 x 12 glass with plain frames and cased with single architraves the windows robbing blinds with suitable hinges and fastings The second story must be divided into a court room two Jury rooms and a hall as seen in plan each of the Jury rooms must have a door cased with single architraves and a good mantel There must be a leading from the stair hall to the court room two fold. The courtroom must also have a railing extending entirely a cross the room with two double doors in it a seat inside the railing. Six Jury seats a clerks desk and Judges Bench raised upon a platform with two flight of steps leading to it and hansomely finished with pelasters panel work. Said second story must also have sixteen windows 24 lights each 10 x 12 glass and windows of 30 lights each with side lights the large door. These windows to finished like those in first story and handsomely surfased. The base in the 2nd story to be finished with mouldings. These must be a hansome flights of stairs leading to this story from below with hand railing and banister all the doors must be panneled doors with moulding The outside doors 1 3/4 inches thick and the inside doors 1 1/2 inches thick and must have good substantial locks and hinges. The outside doors must be 4 feet wide and 7 1/2 feet high and all inside doors three wide and 7 feet high except the court room doors which must be 4 feet wide and 7 1/2 feet high two fold all the openings to have strong lentils of wood with a trowel arch outside and a dead releaving arch inside all the wood except floor and roof to be painted 2 coast the remainder white. All the materials used in the construction of the building to be of good quality and the work in a substantial and workman like manner. so ends April 15, 1852 Inferior Court in Chambers. It is hereby ordered that John Thompson be appointed Appraiser for the right of way for Southwestern Rail Road Columbus branch on the part of the county. It is also further ordered that the county Treasurer py to Henry Millirons eleven dollars and twenty cents for clearing off the streets of Butler out of any monies not that is in the Treasury not otherwise appropriated. And it is also ordered that the County Treasurer pay to John Sturdivant nine dollars and fifty cents for expenses in contracting for Books for the county. It is also ordered that the court build a court house in the Town of Butler forty four feet by sixty feet out of Brick the lower stories 12 feet high in the clear the upper stories four feet high to be built on the plan of the Court House in the town of Bueana Vista, Marion County Georgia and to received sealed proposals to build said House until 1st Tuesday in June and the contractor to give bond and security for the performance of the work the said house to be completed in eighteen months after contracting for the same. The first payments will be viz 1 set payment in advance, 2nd payment 1st of January 1853 and the third and last payment 1st Jan 1854 one third of whole amount to constitute a payment the clerk to advertize in the Southern Democrat and Columbus Times and It is also further ordered that this court build a Jail House for the use of the County and be let out on the same terms or by sealed proposals as the Court house the Jail to be finished by the 1st of Januaary 1853. At which time the whole amount for building and will be paid the contractor to give bond and security for the performing of the contract Specification of Jail House twenty two by eighteen feet two stories high each story to be eight feet in the clear the lower story to be double walled four inch space between the walls filled and upwards with four inch scandling the lower floor twelve feet thick and the space between the floor and ground to be filled up with The second floor ten inches thick . The top floor resting on the plates four inches thick and heartshing? twenty inches long and showing six inches. One outside door at the upper story 3 feet wide by six feet long with Two shutters to the door the outside shutter to be of Iron inside shutter four inches thick lined sheet Iron bouth swing with sufficient hinges and the hinges well secured to the door and house and secured with good locks and also a trap door 3 feet square with two shutter with sufficient hinges and locks. There is to be a platform three feet square in front of the outside door with good steps running from the ground to said platform all to be made of good heart timber. The lower room to have four windows ten feet by sixteen inches well secured with iron bars crossing leaving three inches space between bars the upper story to have four windows two feet square secured with Iron bars crossing space between bars four inches. Supplement. Inside logs of wall to extend as far as the outside wall . The house to be weather boarded and painted red and the wall to be ten inches thick each and detailed in the best possible manner the house to be completed by the 1st of January next and the court to pay for the above when completed or received. Skellie $2 for freight on books. Tax collector collect 50 per cent on the State Tax for county purposes and pay over when collected to the court. Then the court proceded to let out the building in the town of Butler and a jail house agreeable to advertisement Patrick Adams was lowest bidder for the court house and takes the contract of building of court house agreeable to plan and specifications bidder for the Jail house and takes $5,400. Ordered that the district at line between the Town District and White Water District the said line to be run on east line north ane south of the range of lots which said line now runs through from Brown's Bridge north with the exception of William Stuckeys.
