McCrary respectfully showeth that he is one of the securities in the Bond of Henry R. McCrary as Administrator of the Estate of Andrew McCants dec'd of said County. And your petitioned further shows that the country is in a very unsettled condition and that its laws have been made subordinate to the will of a military dictator where orders are mercilessly enforced by the bayonet though they may ruin helpless wiods and dependant orphans. Your Petitioner further shows that said Administrator has not for a number of years made any return to your Honor of his actings and doing as said Administrator. And while your Petitioner does not believe and therefor does not charge that it is the intention of said Administrator to injure him, yet such, your Petitioner, fears will be the inevitable result of the combined influence of the aforesaid promises. Your petitioner feels that justice requires that instead of pursuing a course that would injure himself and family he should endeavor to provide for the wants of that future that may bring sickness and many unforeseen evils in its train. Wherefore your Petitioner prays the Court to take such steps as may be necessary to release him from all further and future liability on the said bond of Henry R. McCrary, Administrator as aforesaid. And your Petitioner will foever pray Lucius Q.C. McCrary The Defendant is hereby required personally or by attorney to be and appear at the next Court of Ordinary to be held in and for the County of Taylor on the First Monday in April next then and there to show cause why Plaintiff's prayed should not be granted and also to be prepared to give other security on said Administration Bond in case Petitioners application should be granted.
