Bryant Admin with the will annexed of said William H. Lowe, is hereby appointed complainant pg 415 We the specialjury find and decree that the property mentioned and bequeathed to said def't Martha T. Lowe in the third term of said will of Wm H. Lowe except a negro woman Mariah who is dead which said will is annexed to said to wit George, a Negro man now about 23 years , Ellen a woman now about 27 urs; Lilly a girl about 15 yrs, Ben a boy about 20 yrs, Osborn a man about 50 yrs ;negro man Edmund about __ yrs as given and bequeath by said will and codicil to defendant during her life and at her death to said Martha Ellen Low, the daughter of said Wm H. Lowe, and said def't Martha T. Lowe subject to the limitations that if said Martha Ellen Lowe should die without children the property should return to the estate. Said Martha Ellen died without issue or children living at her death on the 27th Sept 1857 that the heirs of law of said William H. Lowe to wit the next of kin: William R. Lowe, Sarah A. Bryant, wife of John W. Bryant, Patience L. Gates, wife of Thomas K. Gates, James M. Lowe, Augustus L. Lowe and Rosana Lowe children next of kin and heirs of Wm H. Lowe are entitled to all the property as aforesaid after the death of said Marth T. Lowe. We further find and decree that said Martha T. Lowe do execute to said next of kin and heirs good and sufficient security residing in said county of Taylor in a sum to be fixed by the Judge of this court. William R. Worthy Distribution of estate of James M. Marshall to which Lucy A. Worthy is entitled - 1/16 share; that settlement be made for her own separate use and benefit with remainder to her children her surviving , that Culverhouse and Anstry Solicitors for complainant do collect for thier fees the sum of $40 that Jacob Joiner be appointed trustee for said Lucy A. Worthy, and that the trustee be allowed to make use of funds to be most advantageous to Lucy and her children pg 419 Petition of Andrew McCants sheweth that William P. Taylor, formerly of this county, but since removed from the state, was by reason of the last will of George L. Taylor (5th Feb 1855) was appointed the legal trustee of Pitt M. Taylor who was entitled to the sum of $740 which was put in trust. Wm P. Taylor remained trustee until Nov 7 1857, when he was legally discharged from the trusteeship, and that your petitioner on the last day of the year was named trustee. He is no longer willing to perform the duties. Asks that David O. Smith be appointed trustee. Pitt M. Taylor is non com pos mentis. So ordered. Exhibit shows that his wife and all his children except Javan should first be paid $800 equal to what his son, Nathan H has had and remainder to be equally divided between his siad wife and his sons, Nathan H., William P., Joseph F.
