All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Virginia Crilley http://www.genrecords.net/emailregistry/vols/00003.html#0000642 December 17, 2004, 8:29 pm 14th Dis LL209 Written: 1856 Nathan Taunton, late of Macon Co deceased died intestate leaving considerable property to his children, whereas Thomas Downing, County of Taylor, has lately married Malessa [Melissa] M Taunton, one of the daughters, and heirs at law of said Nathan Taunton is justly entitled to the one fifth interest of Lot of Land number two hundred and twenty one in the first district originally Muscogee now Macon County and Thomas and Malissa M are desirous of changin said Interest in said land for a residence in the county of Taylor. Now this indenture made and entered into this the twenty six day of April eighteeen hundred and fifty six between Osborn Downing of the said county of Taylor of the one part and said Thomas & Malissa M. Downing his wife of the other part of the same county and state. Witnesseth that the said Osburn Downing for and in consideration of the sum of Two Hundred fifty dollars to him in hand paid out of the effects of the said Malissa ___ indeed to the possession of her said husband the right of which sum is hereby acknowledged hath granted, bargained and sold unto the said Thomas Downing in Trust for his said wife, Malissa all the north half of lot of land two hundred and nine lying and being in the fourteenth District of originally Muscogee now Taylor County containing one hundred and a quarter acres be the same more or less. The said bargained premises unto the said Thomas as Trustee and not in his own right, I warrant and forever defend against myself & my heirs and all other persons whatsoever the lot of land is to be for the use of said Malissa and her children and not subject to the debts of the said Thomas in any way whatever and not to be sold unless by the consent of said Malissa and the proceeds threof to the use of said Malissa and her children if any.
