Further agreed that Head shall deliver to said Montfort & Colbert the said Milley, Charles and Lewis on the condition on hereafter expressed. Agreed that the action to recover said slaves in Taylor Co will proceed and no objections taken to the same by reason of the said Heard having got possession of said negroes but the same to proceed as though he never had got the same in his actual custody. Parties consent to the sale of Negroes, the amount of sale and interest should stand as the measure of damages in said trover case.
