Duke of Taylor County & Darling Duke of Marion County by the Bank of Americus the grantee and in order to secure the payment of two certain drafts both dated this day drawn by Henry N. Duke & endorsed by Darling Duke both of said Notes being for the amount of Ninety Dollars and seventy cents each, one due Nov 1st 1879 & the other due Nov 15th 1879 and all other Notes or drafts which the grantors may execute to the grantee during the present year to the amounts of ____________ Dollars, the said grantors Henry N. Duke & Darling Duke hereby sells, aliens and conveys to the grantee The Bank of Americus the following described property, Lot of land numbers two hundred & thirty one (231) in the 3rd district of originally Muscogee now Taylor County and no. two hundred & forty one in the same Dist & Marion County, containing four hundred & five acres more or less and also upon our crops of all Kinds including cotton, cotes, cotton seed, fodder wheat oats & crops now on hand and to be grown by us the present year in the Counties of Marion & Taylor. Now upon payment of said Drafts or Notes to the amount above stated by the said grantors to the said grantees the Bank of Americus this Deed and said Notes or Drafts shall be paid. For a valuable consideration the grantors hereby expressly waives their rights to Homestead and Exemption in property herein conveyed and renounces any exemption they may have taken. In Testimony in hereof the said grantors Henry N. Duke & Darling Duke hath set their hand and seal. Signed, sealed & delivered in presence of us Henry N. Duke This Jany 17th 1879 Darling Duke J.B. Hudson, who after being duly sworn says That he was a subscribing witness to the written (above) Mortgage that his signature as such witnes is genuine & that he saw the makers of said Mortgage Henry N. Duke & Darling Duke sign seal & deliver the same for the purpose therein mentioned & that he saw the other witness Thos. J. Superior Court Record Deeds & Mortgages Homestead 216. 1870 Census #61 Taylor Co Ga. Elisha Duke was also there 1879 Henry and Darling appear together on a mortgate at the Bank of America. They jointly offer their homesteads as collateral for bank notes.
