Thomas D. Humphries to Effa Ann Carter (Crawford) "in
consideration of a marriage to be had & solemnized
between said Thomas D. Humphries and Effa Ann Carter
All the said tenements, negroes,goods, chattle which
said Effa Ann Carter has in her own right in the hands
of her guardian, Gideon Newsome, which is now and her
the said Effa Ann Carter on which may hereafter become
due to her from her said guardian Gideon Newsome or
which may be due and comein from the Administration of
her the said Effa Ann Carter's Fathers, James Carter's
estate to her the said Effa Ann Carter and all property
or properties of what kind  soever which may be given
to her the said Effa Ann Carter by will or deed or
otherwise shall form and remain to her separate
property & estate & shall not either in law or equity
be subject to the payments of the debts of the said
Thomas  D. Humphries.  But the right & title to said
lands, tenements, negroes, chattle shall be vested in
the said Thomas D. Humphries for the sole use and
benefit of the said Effa Ann Carter and the said Effa
Ann Carter nominates and appoints the said Thomas D.
Humphries her trustee of said property who is
authorized to possess herself of & contol all of said
property in conformity with this indenture without
account & the said Thomas D. Humphries consent & agree
to his said appointment as Trusteee as aforesaid. And
the said Thomas D. Humphries further consents for
himself, his heirs , executors, administrators that
should the said Eff Ann Carter on her death leave any
heris or heirs of her body or representatives or
representatives of heirs or heir then in what case he
the said Thomas D. Humphries , Trusteee as aforesiad
will pay all & every part of said property to the heir
or heirs or representatives of heirs of her body and
said Thomas D. Humphries Trustee as aforesaid should
have all of said property to himself, forever in fee
simple.

In testimony whereof the parties to this indenture
have herunto set their hands & seals this day & year
being above written.

NOTE: Effa Ann Carter of James Bascomb and Alia Newsom
Carter.  In 1850 Crawford Co Census she is living with
Martha and Gideon Newsom.  She married Thomas Humphries
12/31/1851. She is named (along with her son, Dubose
Humphries) in Gideon Newsome's will - May 2, 1864
