Clarke against Benjamin Wilson, James Layfield, Sheriff of the county of Taylor did publicly seize the following land hereinafter described as the property of the said Benjamin Wilson and after being advertised agreeable to law and on the fourth of September in the year one thousand eight hundred and fifty five at the place of public sale in the said county, expose the same at public outcry when Nathaniel Spears being the highest bidder the same was knocked off to him at the price or sum of ten dollars.  Now this indenture made this the fourth day of September in the year of our Lord, one thousand eight hundred and fifty five between the said James Layfield, Sheriff, as of one side of the one part and the said Nathaniel Spears of the other part.  Witnesseth that the said James Mayfield, Sheriff as aforesaid for and in consideration of the sum of ten dollars to him in hand paid by the said Nathaniel Spears at and before the sealing & delivery of these presents and the receipt whereof is hereby acknowledged hath granted, bargained, sold and by these presents doth grant bargain and sell so far as the office of Sheriff authorizes him, unto the said Nathaniel Spears, his heirs and assigns all that tract or parcel of land lying and being in the thirteenth district of originally Muscogee but now Taylor County, known and distinguished by the number one hundred and eleven (111) containing two hundred two and a half acres more or less, together with all and singular the rights, members and appurtenances thereof, unto the said lot of land thereto belonging, or in anywise appertaining  and also all the right title interest properly claim and demand of the said Benjamin Wilson in low equity or otherwise whatsoever if in a __________.           To have and to hold the said lot of land and premises and every part thereof unto the said Nathaniel Spears his heirs and assigns to the only proper use, benefit and behalf of the said, his heirs and assigns in as full and ample a manner as the said Benjamin Wilson, his heirs and assigns and as might have been said here, and enjoyed the same had it not been seized and __________ the execution aforesaid.  In witness whereof the said James Layfield, Sheriff hath hereunto set his hand and affixed his seal the day and year first above written.  Signed, sealed and delivered in present of.
