The only eye witness to the killing was Laura Gibson, mother of Leona Elliston, who testified that she had seen her daughter strike the deceased on the top of the head with the blade of an ax sufficient to cause death. Davis lived from 11 o’clock Monday until 12 o’clock Tuesday.
