JOHNSON Crawford County, Ga. 12 Aug 1848 In the name of God Amen. I, WILLIAM L. JOHNSON, of the above state and city, being advanced in age and very infirm and believing that I must shortly depart this life, deem it right and proper, both as it respects myself and family that I would make a deposition of the property which kind providence has bestowed upon me. I therefore make this my last will and testament hereby making all others heretofore made by me, null and void. My first desire is that my body be buried in a descent and christian manner. My soul I trust shall return to rest with God who gave it, as I hope for eternal salvation through the Blessed Lord and Savior Jesus Christ, having professed his religion and as I humbly enjoyed for (27) twenty seven years. Second Item: I desire and comman that all my just contracts be settled by my executors. Third Item: I bequeath to my beloved wife Lavina, with whom I have lived in strong bonds of affection for (26) twenty six years, all my lands in the above named county to which I have a just and lawful title, during the time that she remains unmarried. Should she ever marry, I command that my whole estate be sold by my executors hereafter named, and all my children receive their equal share except the younger children, who have not received an education in proportion to the elder. Tis my command that they be educated at the expense of my estate and each child to have a Guardian. Fourth Item: James Griffith and West Stevens are to have the use of the lots of land upon which they now reside during the year (1849) eighteen hundred and forty nine, for improvements that they have already made and the same up to the present date and my estate is to pay for the planks used about his (West Stevens) dwelling house. I also give and bequeath to my wife a certain negro woman, Angeline and her two children, Alfred and Abel, except she should marry, and then said negroes are to be sold as my lands, and the rest of my property in case my wife should die before all my children are educated, money must be reserved out of the Estate, to educate them as the rest have been. I desire that my wife keep all my personal property that she may think best for the use of herself and children under age, while they remain with her and my executors are to pay out of my estate the amount of four hundred dollars ($400), and if any of the heirs are over pair, it is to remain so until my whole estate is wound up and then if anything more is coming to said heirs they are to have an equal share with what they have already received. And as my younger children become of age there is to be paid to each one the sum of four hundred dollars (400) without delay by executors. And if the said negro woman Angeline should die, or become unable to do domestic duty, my executors are to buy another in her place, and if times and trade should _____, I command that my lands viz. lots #5 and 6, five and six, in the old agency reserve, west side of Flint River in Crawford Co., Ga. should be sold by my executors whenever they can get four ($4.00) dollars per acre and upwards for said lands and this money loaned out to the best advantage of my estate. Corbin in whom I have the utmost confidence, believing that they will do their duty and avoid any difficulty or law suit with my heirs if possible and if this testiment is not according to form in law, nevertheless it is my own verbage and it is my last will and desire that my heirs abide by it without any complaint or interruption amongst themselves. 12 Aug. 1848 Signed and Sealed: WILLIAM L. JOHNSON late of said county deceased having been at this present Term of this court proven on the oath of William R. A. Ingram and David Bowens, two of the subscribing witnesses thereto. It is therefore on motion ordered that the said last will and testament be admitted to record in terms of the law and that WILLIAM T. JOHNSON, one of the executors in said will appointed be qualified and that the clerk _____ to him better testamentary in terms of the law, and this order be entered on the minutes of the court.
