Will of Samuel Montgomery 14 Oct 1861 Taylor County, GA Will of Saml Montgomery Dec'd Georgia ) In the name of God Amen: Taylor County ) I, Samuel Montgomery being of advanced age but of Sound and disposing mind and memory knowing that I must shortly depart this life deem it right and proper both as respects my family & myself that I should make a disposition of the property with which a kind Providence has blessed me. I do therefore make this my Last Will & Testament bereby revoking & annulling all others by me heretofore made First: I desire and direct that my body be buried in a decent & Christianlike manner suitable to my circumstances & condition in life. My soul I trust shall return to rest with God who gave it as I hope for salvation throught the merits and atonement of the blessed Lord and Savior Jesus Christ Secondly: I desire & direct that all my just debts be paid by my Executor hereinafter named and appointed Thirdly: I give and bequeath to my sons William Montgomery, Vincent and Seaborn Montgomery all the property of whatever kind, now in their possessions set apart by me and derived from me to them and heirs forever Fourthly: I give & bequeath to my daughter Lucinda Carter, Jane a negro woman and her four children & their future increase. Gus, a boy, Violet, a girl & Mary Ann a girl & Silla a girl, during her natural life and at her death to be equally divided amongst her children not to subject to the contracts mangement nor debts of her present or any future husband. Fifthly: I give & bequeath to my daughter Mary Jones, Frances a negro woman and her two children & their future increase Allen a boy - Amanda a girl and Charles a boy during her natural life and at her death to be equally divided between her children not to be subject to the contracts management nor debts of her present or any future husband. Sixthly: I give and bequeath to my daughter Fereby Carter, Mourner a negro woman and her two children and their future increase. Amanda a girl and Fanny a girl during her natural life and at her death to be equally divided between her children not to be subject to the contracts management nor debts of her present or any future husband. Seventhly: I give and bequeath to my daughter Sarah Montgomery - Tabitha a negro woman and her child Elizabeth and their future increase during my said daughters natural life and at her death to be equally divided between her children not to be subject to the debts or contracts of any future husband. Eighthly: I give and bequeath to my (sic) Eliza Montgomery - Harriet a negro woman and her child Ellen a girl & their future increase during my said daughters natural life and at her death to be equally divided between her children not to be subject to the debts or contracts of any future husband. Ninthly: I desire and direct that my Executor hereinafter named & appointed sell the remainder of my property whatever & wherever found & the proceeds of the same to be equally divided between my Wife & all my children share and share alike the respective shares of each of my daughters to be for their own sole & seperate use during their natural lives & at their respective deaths their respective shares to be equally divided between their children - said share not to be subject to the debts or contracts of their present or any future husband.
