A. J. Willis, of the State and County aforesaid being of sound disposing mind and memory, and knowing that it is ordained for all the living to die, have determined to make this my last Will and Testament, hereby revoking and annulling all wills and testaments and codicils heretofore made by me and do declare that it is my will at my death that all the property of which I am possessed shall go and descend as follows: Item 1st I will that all my just debts be paid by my Executors herein after appointed. Item 2nd. I give and bequeath to my beloved wife, Rebecca A. Willis my house and lot in the town of Butler No. 7 Block 4 in lien of her whole dower to have and to hold during her natural life or widowhood, after that to be equally divided between my legal heirs. Also I will that she shall have one share of South Western Rail Road Stock. I furthermore will that she have the cow and calf named Daisy and her future increase. I also will that she shall have one hundred dollars in money for a years support. It is my will that after she receives the legacy named that she shall have no further interest or claim in my estate. Item 3rd. I will to my daughter L. A. Smith two shares of South Western Rail Road Stock. Also I will to Mrs. M. E. Robertson two shares of South Western Rail Road Stock. Also I will to the children of my deceased son, C. M. Willis, two Shares of South Western Rail Road Stock. I also will to the children of my deceased daughter J. I. Parker, two Shares of South Western Rail Road Stock. I also will to my daughter M. A. M. Brown, two Shares of South Western Rail Road Stock. Also I will to my son A. B. Willis, two Shares of South Western Rail Road Stock which has been sold and he has received the money and placed a note in lien of his settlement of the two Share of South Western Rail Road Stock. Also I will to my son G. J. Willis, two Shares of South Western Rail Road Stock, also my gold headed cane. Item 4th. After the legacies named in this instrument shall have been received, I will, that the remainder of my property be sold for cash, and the proceeds be divided among my legal heirs. And if any of my heirs make any effort to annul this will, it is my declared purpose that they forfeit all rights of claims to any of my estate. Item 5th. I do hereby appoint and ordain my son Geo. J. Willis and my friend W. L. Caldwell my Executors to execute this my last Will and testament. In witness whereof I the said D. A. J. Willis, of said State and County being of sound and disposing mind and memory, do make this my last will and testament. Item 1st. I add this codicil to my last will and testament. If any of my heirs shall ever attempt to annul my will and attempt to break or change it in any way, it is my positive will that they shall have nothing from my estate whatsoever. Willis, of said State and County, being dissatisfied with Item 5th of my last Will and testament, made this 23rd day of January 1895, & witnessed by F. Matthews, T. E. Huff and J. R. Hunter, J. P. and I desire to make this change in said Item Fifth I hereby revoke the appointment of my son Geo. J. Willis as one of my Executors of my last Will and testament & appoint in his place, my grandson in law, H. H. Waters, now section foreman on the Central of Georgia Railway Company & this codicil is hereto attached to my last Will and Testament. Willis died on the 4th day of August 1903 testate and that the Executor of said Will refuses to qualify and The Estate of said D. A. J. Willis is unrepresented and that There is more heirs and beneficiaries of the said deceased and that a portion of the heirs of said D. A. J. Willis have taken charge of a portion of the personal property and divided among themselves and carried it from the residence and premises of said D. A. J. Willis deceased and that it will be some time before a permanent administrator with the Will annexed could be appointed and that the interest of said estate demands That a temporary administrator be appointed immediately. Wherefore your petitioner prays that A. T. Montfort Clerk of the Superior Court be appointed temporary administrator of said Estate. J. J. Willis a resident of said Sate shows to the ordinary of said County that on the 4th day of August 1903 D. A. J. Willis a resident of said County died owning real & personal property in said state having previous to his death executed his last Will and Testament. That W. L. Caldwell was appointed executor of said Will by a codicil made subsequent to the execution of said Will and Who refuses to qualify as executor. Said Will is now filed in the office of said Court your petitioner shows that the following persons are the next of kin of said D. A. J. Willis having an interest as heirs at Law, of said D. A. J. Smith & Mary, Bessie, Jessie, Curtis, Jack & Frank all the children of C. M. Willis and who reside in the state of Texas, your petitioners pray that will be proven in solemn form & that celotum do issue as the statue provides to said next of kin and that a Guardian adliterm be appointed to represent said minors where made a party by proper service.
