This indenture made the thirteethn day of November in the year of our Lord One 
thouand Eight hundred and sixty betwen Wm. H. Tait of the one part and James 
A. Hurst of the other part of Mitchell County said State witnesseth that the 
said Wm. H. Tait for and the consideration of the sum of two hundred dollars 
cahs hand paid by the said James A. Hurst the reciept of is hereby 
acknowledged does by these presences grant bargain sell and convey unot the 
said James A. Hurst his heirs and assigns all that tract or parcel of lying 
and being in the county Irwin and state of known and destinguished as Lot 
number (128) one hundred and twenty eight in the first district of said county 
with all the appurtenances priveledges rights and threof to have and to hold 
the said described premises unto the said James A. Hurst his heirs and assigns 
fee simple forever and the said William H. Tait will for himself his heirs 
executors and administrators wil forever warrarnt and defend the right and 
title unto the said James A. Hurst his heirs and assigns myself and against 
the claims of all other persons who ever in (?)  where of I have here unto set 
my hand and affixed my seal and in testimony (?) (?) the day and year above 
written signed sealed and delivered in presence of

Before me came in person John M. Hurst who bring duly sworn diposeth and saith 
that he saw W. H. Tait sign seal and deliver the written deed further purposes 
there in mentioned and saw James D. Smith sign the same as a witness and done 
the same myself likewise sworn to and described before me this Oct 5th 1861
