First, it is my wish and desire that should my beloved wife Mary McKinnon survive my death that she should have the use and control of all my property both real and personal which I may be possessed of at the time of my death after paying all my just debts for her own benefit and for the benefit of my children who will remain with her subject to the following distributions. Second, it is my wish that the net proceeds of each crop after defraying the necessary expenses of the family, be reserved as a fund for the puprpose of purchasing land until there shall be a sufficient quantity, including the lands I may be possessed of in this county for each of my four sons, viz. Roderick, Kenneth, Murdock and McIntosh, and to receive one lot each in this county, but if the land should be rich or high priced a half lot in proportion to the value. Third, it is my wish that my daughter Elizabeth should have a good horse, saddle and bridle, and if she should remain single to have a competent support during her natural life out of my plantation whereon I now live in addition to her proportionate share of my property. Fourth, it is my wish that each of my six children who live with me at this time, viz. Elizabeth, Roderick, Kenneth, Murdock, McIntosh and Mary should receive as much property when they get married in addition to the above as I have given to my other children who have married and left and that my sons should receive one year support from my plantation until they have time to make support themselves. Fifth, it is my wish that my wife and children should remain together and hold the remainder of my property in common stock as long as two remain single and during her natural life. Sixth, it is my wish that the last of my sons who shall remain single should have the lot of land I now live on that is number 128 in the 13th district formerly Irwin now Thomas County or his part of the land subject to the disposition before mentioned to receive a settlement of land in this county, I wish the above described lot divided between the two last who remain single and I wish all the livestock they may have in possession at that time together with farming utensils and household furniture divided between my two sons last mentioned as their part of the block and furniture. Seventh, it is my wish my lands in this county would remain with my family and not be transferred to others. Eighth, I wish it understood that if any of my children before mentioned should receive from me during my life their proportionate share as described above that afterwards they will only be entitled to an equal share with my children who have received theirs already. Ninth, it is my wish that the remainder of my property after the above requestions are complied with and the foregoing purposes answered should be divided among all my children, viz. Malcolm, Elizabeth, Roderick, Neill, Nancy, John, Margaret, Kenneth, Murdock, McIntosh and Mary. Tenth, it is my wish that my sons Malcolm and John McKinnon be my executors for the purpose of carrying the above requisitions into execution agreeable to their true meaning in witness whereof I have hereunto set my hand and affixed my seal this ninth day of September in the year of our Lord eighteen hundred and thirty-five. Pugh Georgia, Thomas County March 6, 1837 The written last will and testament of John McKinnon, having been duly proven at this regular term in open court upon the oaths of Jesse E. and William W. Pugh ordered that the same be admitted to record. Attest Neill McKinnon C.C.O. I Malcolm McKinnon and John McKinnon do solemnly swear that this writing contains the true last will of the within named John McKinnon now deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the tenor of said will authorizing me to take charge of, so help me God. Attest Neill McKinnon C.C.O. Additional Comments: The son of a Scottish immigrant, John McKinnon was born ca. 1773 in North Carolina. After a few years in Montgomery County, GA, he moved with a large family contingent, including his wife Mary's brothers Murdock and Roderick McIntosh and their children, to Thomas County about 1830. His plantation was between Thomasville and Boston. He died of measles in 1835. Daughter Elizabeth who inherited a horse did not remain single; she married Thomas Pugh. The only child who did not marry was Roderick, who farmed his father's land for years to come. Many McKinnon descendants remained in Thomas or Brooks County (when it was formed). Daughter Margaret married a man named Malcolm McKinnon and later moved to Echols County. This will was transcribed by Mary Wilson from a microfilm copy.
