Small of stature, with short brown hair, Mrs. Foskey listened intently as the witnesses gave their testimony and were cross-examined by the state. Mrs. Foskey is charged with shooting her husband, Alvin Foskey, on Sunday morning April 4th after he allegedly been out all night and had come home drinking and started a fuss and fight. An uncle, Marvin Wheeler, who lived next door to the Foskey home in Gloverville and who went to Mrs. Foskey's help, was reportedly attacked by Foskey. It was at this point that Mrs. Foskey is said to have gone into the house and got the psitol and shot her husband twice in the back. The first thre witnesses were Officers W. W. McTeer and W. C. Creed, and the examining physician Dr. A. A. Walden. Creed gave the testimony as given him by Mrs. Foskey saying " I ran into the house when my husband was wrestling in the yard with my uncle. I got a 22- caliber pistol and shot my husband." After Solicitor Leonard A. Williamson had asked Creed to reaffirm the above statement, John Williams made a motion that the court grant a directed verdict since the state had made a case of self-defense, showing that Wheeler was unable to defend himself and so his niece acted in his behalf. The motion was overruled. Mrs. Wheeler Testifies Mrs. Willie Wheeler, an aunt of the defendant, was next on the stand and her testimony.......
