GA Wills 1 (A), p. 129 WILL OF EDWARD CASTLEBERRY 1840 Georgia, Troup County } In the name of God Amen, I Edward Castleberry of the County & state aforesaid being afflicted in body but of disposing mind and memory do make ordain and appoint this my last will & testament. Item 1st It is my will that my body be decently intered after my decease and that the expenses thereof be paid by my Executors hereinafter appointed out of the proceeds of the growing and gathered crop after my decease or out of monies in cash that may be in hand at my decease. Item 2nd It is also my will that all my just debts be paid by my Executors hereinafter to be appointed out of the proceeds of my crop as in item 1st aforesaid. Item 3rd I give and bequeath unto my beloved wife Sena Truit Castleberry the plantation & farm wherein I now live containing four hundred & sixty acres more or less being the entire lot number fifty seven of the Sixth district of originally Troup County & State aforesaid, one hundred and sixty acres off of lot number fifty eight of Sixth district T County (which has not been heretofore at anytime transferred and conveyed by me to any person) and one hundred acres off of Lot number seventy two in said district being the North half of said lot of land - also the following Negroes to wit, Tom a man & his wife Rose and their three children Dolly about twelve years old and Leah about ten or eleven years old and a suckling child named Rossetta- also Ben a man about twenty two years of age and Simon about nineteen or twenty, a boy by the name of Ransom about sixteen years old and an old man by the name of Sawney--I also give my beloved wife three horses to be selected by her and my Parrich? & harness, six choice cows & calves and thirty head of hogs to be also chosen & selected by her, also the household and kitchen furniture of which I be possessed and the entire crop of corn fodder, oats, wheat, cotton, grown & gathered on my said farm & plantation the year of my decease after the payment of such expenses, debts & demands as I are in the first and second items aforesaid mentioned: all of which said property real & personal heretofore given & bequeathed in this item to my said wife is to be possessed and enjoyed by her unchanged and undisposed of by transfer or sale or otherwise during her natural life - and at her death to be sold and the proceeds thereof equally divided between my son Warren G. Castleberry, my daughter Angelina Slaughter, the wife of Nathaniel G. Slaughter formerly Angelina Castleberry to be delivered to the said Nathaniel G. Slaughter in trust for his wife, the said Angelina for & during the time of her natural life and at her death to be equally divided between the lawfull heirs of her body, my son Allen Castleberry, my daughter Emily S. Cameron the wife of James H. Cameron formerly Emily S. Castleberry to be delivered to the said James H. Cameron in trust for the said Emily S. for & during the time of her natural life and at her death to be equally divided between the lawfull heirs of her body, and my daughter Lucinda Thornton the wife of John T. Thornton formerly Lucinda Castleberry to be delivered to the said John T. Thornton in trust for his wife the said Lucinda for and during the term of her natural life and at her death to be divided equally between the lawfull heirs of her body. Item 4th I give bequeath & confirm unto my daughter Emily S. Cameron formerly Emily S. Castleberry & James H. Cameron her husband the money Negroes & their increase & all other property given to her & him heretofore and I do hereby give & bequeath to my said daughter the said Emily S. and her husband the said James H. the tract of land whereon they now reside being lot number seventy one & one half of lot number seventy two being the South half of said lot of land and forty acres of land off of lot number fifty eight being the same portion of said lot formerly owned by my deceased son Edwin Castleberry and all of the Sixth district of original Troup County - Item 5th I give bequeath & confirm unto my daughter Lucinda Thornton, the wife of John T. Thornton formerly Lucinda Castleberry and her husband the said John T. the money Negroes and their increase and other property heretofore given them, and I do also give her the said Lucinda and her husband the said John T. a negro man Alfred about twenty five years old - Item 6th The Negroes and other property heretofore loaned by me to Nathaniel G. Slaughter formerly Angelina Castleberry I do hereby give and bequeath to the said Angelina during her natural life to be kept in possession & controlled by her husband the said Nathaniel G. Slaughter in trust for his wife the said Angelina and at her death to be sold and equally divided between the heirs of her body - Item 7th I give and bequeath to my son Allen Castleberry a promissory made payable by him to me as Executor of Thomas Castleberry deceased for the sum of Eleven hundred dollars with interest from date and payable at date & dated the July twenty ninth day, Eighteen hundred and twenty nine and I do hereby request my Executor hereinafter to be appointed to deliver to my said son the note above described taking his receipt for the same- - Item 8th I give and bequeath to my son Warren T. Castleberry a promissory note payable by him by the tenth day of December next (after date thereof) to me as Executor of Thomas Castleberry deceased for two hundred and sixty four dollars and eighty four cents, & dated 29th Dece 1838: and I do hereby instruct my Executors herein after appointed to deliver to him said note takeing his receipt for the same - Item 9th It is my will that the ballance and residue of my Estate both real and personal not hereinbefore disposed of be exposed by my Executors hereinafter appointed to public sale giving sufficient notice thereof as early after my death as practicable and from the proceeds thereof and the debts due me individually and as Executor of the last will and testament of Thomas Castleberry deceased which I desire to be collected as speedily after my death as possible. to be applied to a settlement with the proper representative of the Estate of Thomas Castleberry deceased duly and legally constituted & appointed according to law, and such other claims as may exist against me, and as soon as such settlement can be effected the ballance of proceeds of said sale & collections & the amount of cash on hand at my death to be divided between my daughters Angelina Slaughter formerly Angelina Castleberry, Emily S. Cameron formerly Emily S. Castleberry, Lucinda Thornton formerly Lucinda Castleberry and the lawfull heirs of the body of my daughter Lavitha Webb formerly Lavitha Castleberry (whose names are not now recollected) in the manner hereafter directed, to wit: to each of the lawfull heirs of my daughter Lavitha Webb formerly Lavitha Castleberry, my desire is that my Executors pay the sum of fifty dollars to be paid to Guardians duly authorized & appointed for that purpose by law; and it is my will and desire that the whole of the ballance raised as in the Item first aforesaid be equally divided between my daughters Angelina Slaughter, Emily S. Cameron & Lucinda Thornton share and share alike, to be delivered to the husbands of each & used by them in trust for their benefit. Each of my said daughters aforesaid to have a lifetime Estate therein and at their deaths and each and either of them the share hereby given and bequeathed them to be divided equally between each of their lawfull heirs respectively - Item 10th I do hereby constitute and appoint my dearly beloved wife Sena Truit Castleberry my Executrix and my son-in-law James H. Cameron and my friend Kinchen L. Haralson Executors to carry into full and complete effect this my last will & testament hereby revokeing and annulling all former wills made by me--As witness my hand and seal this Eleventh day of June in the year Eighteen hundred & forty.
