Will of Daniel Norwood, Troup Co. GA Submitted by Mary Padget Will of Daniel Norwood WILL OF DANIEL NORWOOD August 10th 1861 S. Cartright ordy In the name of God amen I Daniel Norwood of said State and County do make this my last will and testament in following items to wit. ----- hereby direct that all my just debts to be paid by my executor with as little delay as possible. Item Second To my beloved wife Sarah during her life ------- and bequeath the sum of one hundred dollars ---- to --- over to her or expended for her benefit by my Executors ---- her wants or to gratify her in any other manner. --- Beds , Bedsteads & furniture and as much other furniture--- furnishing her bed room as she may want all of ---- to remain at the place where she may be living at the time of her decease to belong to the family with whom she may be living now contemplated to be with my daughter Martha J. Speer also I will & bequeath to my wife during ---- my Negro Girl Mary to wait on her as a servant attendant & at her death said Negro and her children if any to be equally divided between such of --- heirs as I shall hereinafter name. Item the third I will and bequeath the following Cash --- as special to with to the children of my deceased son John three hundred dollars [,] to my son William [seven?]-n hundred dollars to my daughter Martha J. Speer seven hundred dollars. Item the fourth I will and bequeath to my son James a life Estate of all that portion of my plantation upon which I now have a farm lying north of the road leading from Dr. W.A. Speers residence by way of Mr. James McFarlins and intersecting the Corinth and Hogansville road including that portion of lot of lands number fourteen which lies/is South of said roads the whole containing about three hundred and seventy-five acres and at his death to become the property of his chidden & if his children should all die in their minority Said Settlement of land or its proceeds if it shall have been sold shall revert & become a part of my Estate. In the division of my Estate Said described portion of land is to be assigned to my son James at its market value at that time. I also give and bequeath to my Said Son a Negro man named Adam at his market value so as to be accounted for in the distribution of my Estate. I hereby appoint my sons William C. And Andrew P. Norwood Trustees for my said son James to control the titles of the aforedescribed property herein bequeathed to him. If the value of said portion of land and of said Negro man does not amount to one fifth of the value of my Estate after paying off the special legacies of cash mentioned in the second & third items of this will then the same is to be made equal to the one fifth by balancing with each [cash?]. It is my will & desire that in the event of the death of my said son James his widow shall live upon said settlement of lands as a home until his children become of age provided she does not remarry. Item the fifth. I will and direct that the remainder of my Negroes shall be divided into four lots of above equal value which lots shall be drawn for by ballot commencing with the legal representatives of my deceased son John to draw one lot and then my son William to draw one lit & then my son Andrew to draw one lot & then my daughter Martha J. Speer to draw one lot and at the death of my beloved wife Sarah my aforesaid four children , my son James shall each inherit one fifth interest in the value of the Negro Mary and her increase if any. Item the sixth I will and direct that my Executors shall have discretion to sell the remainder of my land at public or private sale as they may think more advisable (by dividing it into different parts as the most advantageous way of selling g it or selling it in one body) and that the proceeds of said remainder of my lands as well as the proceeds of the sale of perishable property & any other property not enumerated shall be equally divided into fifths for the benefit of my heirs mentioned in item the fifth. Item the seventh all the property herein bequeathed to my daughter Martha J. Speer shall be hers I ---- so that she may dispose of it at her pleasure. Item the eighth I have already given to my son Dr. Wesley C. Norwood a great deal more that it is in my power to give the balance of my children & hence I do not leave him any portion or legacy in this my last will and testament. I hereby appoint my sons Wm. C & Andrew P. Norwood my Executors In writing whereof I have here unto set my hand & seal this August 10th 1861. Signed sealed and declared before us Daniel Norwood John B. Hester Paschal K. Moreland Ordinary Office, Jany 10th 1862 A paper writing purporting to be the last will & testament of Daniel Norwood deceased late of said county and state is brought forward by his sons William C. & Andrew P. Norwood and offered for probate and John F. Moreland one of the subscribing witnesses to said will testifies that he saw testator sign , ---- & declare said instrument to be his last will and testament that testator was of sound mind * at the time and that he made the same freely and voluntarily and that he signed the same as witness and that he saw Paschal K. Norwood, John B. Hester sign the same as witnesses at the time it purports [?] to have been written. John F.
