I, therefore make this my last will and Testament hereby revoking and annulling all others heretofore made by me. Item the 1st: I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition. Item 2nd. I desire and direct that all my just debts be paid without delay by my executors herein after named as I am unwilling my creditors should be delayed of their rights especially as their is no necessity for delay. Item 3rd. I give and devise to my beloved son, Elam Hinson, a negro man named Morris about forty-five years of age and Fanny, a woman, and her five children to wit: Viney, a girl about ten years old; John a boy, eight years old; Neptune, a boy about six years old; Cretia, a girl about four years old; and infant child, Chitty, a girl; and Caroline, a woman and her child, Martha and one sorrel horse and Filis a woman about Eighty years old, To him and his Heirs on the condition that he the said Elam Hinson is to support and maintain his mother, Margarett Hinson, during her life. Item 4th. I desire that my lot of land adjoining Tharp, Solomon, & Wall, also my negro man (viz) Isaac, a man 25 years old, Richard, 20 years old, Jesse, 19 years old, all equally divided between my two sons (viz) William Hinson and Caleb Hinson. Item 5th. And the notes I hold against William Hinson he is to pay one-half of said notes to Caleb Hinson and Elam Hinson my Executor is to make a good and sufficient title to the Land whereon the said William Hinson now lives adjoining the lands of Wm. Hollingsworth and J. T. Bond and the other half of said notes is to go to the said William Hinson. Item 6th. I devise to my son Asa Hinson all the notes or other demands I have against him. Item 7th. I Bequeath to my daughter Lucretia Oglesby, the wife of Benjamin Oglesby, all the notes or other demands I have against the said Benjamin Oglesby. Item 8th. I Bequeath to the Rest of heirs to wit: John Stinson or his heirs, to John Bennett or his heirs, to Edmond Bennett or his Heirs, Noah Golden or his Heirs, five dollars to each to be Paid by my Executor whenever applied for by them. Item 9th. The remainder of my effects such as household and kitchen furniture I give and bequeath and reserve to my wife, Margarett Hinson, to use and enjoy her lifetime and then dispose of as she pleases. Item 10th. I now constitute and appoint my son Elam Hinson my Executor to this my last Will and Testament. Item 11th. The property which I have herein before bequeathed to my son William Hinson I desire and direct that he use and enjoy during his life and if he has no children said property then at his death to return to my sons, Elam and Caleb Hinson. I also appoint my son Elam Hinson as Trustee for said property herein bequeathed to my son, William Hinson. This March 21st. 1845 (signed) Caleb (X) Hinson L. S.
