All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Paula Whatley Matabane pmatabane@bellsouth.net February 20, 2009, 5:24 pm Source: Upson County Deed Book Written: November 12, 1858 Indenture of Andrew Kennedy Upson County November 12, 1858 Deed Book H, p. 391 This indenture made this the 12th day of November in the year eighteen hundred and fifty-eight between Andrew Kennedy of the county of Upson in said state of the one part and Thomas Kennedy and Shattles of the same place and Wilson Kennedy, Ira Ward and of the county of Monroe in said state and John Kennedy of the county of Taylor in same state of the other part is such that whereas the said John Kennedy Senior has this mind to make division among the natural objects of his bounty of a large portion of his estate securing to himself only one annuity to be paid for his support and whereas in pursuance of said purpose and intentions he hath empowered the parties of the other and several part to make sale as his attorneys in fact of certain parts, and parcels of his estate particularly received in a letter of attorney executed and delivered by him to them and bearing every date with these presents. Now these witnesseth that the said John Kennedy, Senior for and consideration of the premises and the considerations herein after set forth doth agree that the proceeds of the sales made under said power of attorney shall after they shall have paid or secured there from the sum of one thousand dollars to the living children of Robert Kennedy deceased and the living children of Thomas B. Durham deceased to be equally divided among them. Share and share alike said division to the effect after any death. And the balance of me estate to be equally divided amongst, go to the parties of the several part - share and share alike. And in consideration thereof the parties of the several part due by these presents and bind themselves to pay to the said John Kennedy, Sr. the sum of fifty dollars each agreeing in the aggregate the sum of three hundred dollars to be due and payable by each of said parties of the second part at the end of each year. The first payment to become due on the first day of January one thousand eight hundred and fifty nine. In testimony whereof the said parties of the first and several part hereto set their hands and seals.
