Clark W. Upson Simon S. Oslin The State of Georgia Upson County The Grand Jurors sworn, chosen & selected for the County of Upson to wit: __ Rogers foreman, Thomas W. Rivier, John S. Jackson, James Harrell, Miles R. Meadows, John N. Howell, Calvin M. Mitchell, James M. Barron, William Stephens, __ C. P__, Jordan Lyons, Peter Holloway, Benjamin G. McKenny, Allen B. Mallory, James Anderson, Washington Hartsfield, Benjamin B. White, Alexander S. Brooks, Butler B. King, in the name & behalf of the citizens of Georgia charge & accuse Clark W. Upson & Simon S. Oslin of the County & State aforesaid with the offence of misdemeanor. For that the said Clark W. Upson & Simon S. Oslin, in the County aforesaid on the twenty sixth day of May in the year of our Lord one thousand eighty hundred & fifty six with force & arms at the town of Thomaston in the County aforesaid the graveyard of & belonging to the said town of Thomaston there __, unlawfully & willfully did brake & enter, & the grave then & there in which the dead body of a negro man slave named William, (the property while living of one Hillard B. Mabry), had lately before that time been interred & then & there was - with force & arms without the consent then & there of the said Hillard B. Mabry the said master of the said negro man slave William while living & without the consent then & there of the said negro man slave William deceased, did then & there unlawfully, wilfully & indecently dig open & then & there the dead body of him the said negro man slave William out of the grave aforesaid without the consent of the said Hillard B. Marby the said master of the said negro man slave William while living & without the consent then & there of the friends of the said negro man slave William deceased, did then & there unlawfully & wilfully take, carry away & remove for the purpose of dissecting & selling the same, the said body of the said negro man slave William being then & there the dead body of a human being, & the said negro man slave William deceased not being then& there at the time of his death & interment a malefactor, executed under sentence of law, contrary to the laws of sais State the good order peace & dignity thereof. And the Jurors aforesaid in the name & behalf of the citizens of Georgia further charge & accuse the said Clark W. Upson & Simon S. Oslin with having committed the offence of removing a dead body of a human being from the grave. For that the said Clark W. Upson & Simon S. Oslin on the twenty sixth day of May in the year of our Lord one thousand eight hundred & fifty six from a grave in the graveyard at & belonging to the town of Thomaston in the County of Upson in said State did remove the dead body of a certain negro man slave named William, the said dead body of the said negro man slave William being then & there the dead body of a human being without consent then & there of the friends of the said negro man slave William deceased, the said negro man slave William deceased not being a malefactor executed under sentence of the law contrary to the laws of said State the good order peace & dignity thereof.
