Original File in office Sept. 11th 1849 M. H. Sandwich (?) Good & Cary We the jury decree that William H. Beall and Elisha H. Beall, the complainants are heirs at law of Alpheus Beall, the InterLATA of Mary C. Beall the defendant and administrator that the said estate which has or shall come to her hands is subject to distribution and that the said estate be divided into three equal shares, one of which is the share of William H. Beall, one share the share of Elisha H. Beall and one share that of Mary C Beall the administrator and that the same be hereafter distributed by this Court or the Court of Ordinary of Upson County and this decree completed by them, and that the defendant pay the cost of this property case, not as administrator but out of her own property. I feel that it should be noted that; Mary C. Beall - Stalling was not a woman without sense or knowledge because; she had a prenuptial agreement drawn up allowing her to retain ownership and control of her separate property. Beall - Stalling Brief history of Mrs. Mary C. Beall - Stalling Mary C. Was married to Mr. Alpheus Beall. While married to Mary, Alpheus had a relationship outside his marrage to an unknown woman. In the course of his relationship, Alpheus Beall had fathered two son's out of wedlock. (William H. Paddgett & Elisha Paddgett). Sometime before his death, Alpheus has his children (son's) legitimized by a private act of the Georgia legislature. Thus the two son's became; William H. Beall and Elisha Beall. Mary his widow flat out refused to share any of the property with his son's that he fathered with another woman, but by this time she had remarried a man by the name of William J.
