Witnesseth Whereas the Said George Cary, to three Several promissory, notes made payable to Isaac Bryon of Columbia County, the said notes being each drawn for the Sum of two hundred dollars each and due in three succession annual payments, and bearing date of 25th May 1838 and whereas it is desirable to hold and secure the Said Simeon Rogers in ___ and ___ Secured, against all risk of loss whatsoever ___ document hereby reason of his undertaking and Stability ___ Said George Cary in the manner and form aforesaid, in Event stated that the said Simeon Rogers should ultimately have to pay the Sum or sums Specified in the Said notes or any part thereof Now this indenture witnesseth that the said George Cary for and in consideration of the premises, to Save the Said Simeon Rogers, harmless from any payment that he might be compelled to make for and by means of his Said Security Ship; and for and in consideration of the sum of one Dollar to him in hand paid at and before the Signing of the said presents, the Receipt whereof is hereby acknowledged hath sold mortgaged, hypothecated, in rights and by these presents doth sell, hypothecated and mortgage unto the said Simeon Rogers his heirs and assigns the two following negro men Harry and Fredrick. Never the less ripen the ___ condition that if the said promissory notes shall be paid off and discharged by the Said George Cary, in Such manner or any reoccurances or resort to & upon the said Simeon Rogers, For the payment of the same or any part thereof, or so that the said Simeon Rogers, Shall not pay the Same or any part thereof; Show the above & foregoing deed of mortgage Shall be nul & void and of no affects whatsoever, otherwise remain in full force & ventue.
