Cary, both of us being of the County and State aforesaid in the just and full lein of Twenty Seven Hundred & Sixty dollars for the term payment of which I bind myself my heirs, Executors, & administrators, jointly & severally, firmly by these presents dated this July the Twelfth Eighteen Hundred & forty nine The Condition of the above Obligation is such, that whereas John J. Cary has this day Executed & delivered to James Adams his promissory Note for Three Hundred & fifty dollars due and payable the twelfth day of December Eighteen Hundred and fifty one which said note is the consideration or purchable money for a certain portion of Land, lying in the North West Corner of Lot No. 136 in the Sixteenth District of Houston originallyy, now Upson County, being bounded on the North by Mrs. Martin's land, on the East by the Dower of formerlly Mrs. English now Mrs. Hutchinson, On the South by the road leading from Wright's Old Store, to McKinney's ferry & on the West Side J. Cary's Land the Said portion of Land supposed to contain fifty Acres more or less, and also his note bearing same date with these payment for One Thousand and thirty five dollars, due and payable to the said James Adams On or before the Twenty fifth day of December Eighteen Hundred & fifty, It being given as the consideration for the purchase of Lot of Land No. One Hundred and twenty One in the Sixteenth District of Originally Houston now Upson County, containing Two Hundred two and half Acres more or less. Now should the said James Adams make or cause to be made good and Sufficient Titles to the said Lot and portion of Land Above described upon the payment of said promissory note & to each portion of said Land upon this performance of the Contract or rather the payment of the note by the said John J Curry, his heirs, Executors, administrators and assigns, then the above obligation to be void, else to remain in full force and Ventru Signed Sealed & delivered }} James Adams [L.S.] in presence of us }} William Trayler }} Register the 10th February 1850 H.
