Jacob King February 25, 1833 Upson County, Georgia Deed Book B, page 358 Document 17 This indenture made and entered into this 25th day of February and one thousand eight hundred and thirty-three between Jesse Newby, Jr. of the county and state aforesaid of the one part, and Jacob King of the same county and state of the other part. Witnesseth that the said Jesse Newby, Jr. for and in consideration of the sum five dollars to him in hand paid the receipt whereof is hereby acknowledged and which was paid by the said Jacob King at the sealing and delivery of these presents as well as for the better securing the payment of a certain promissory note of which the said Jacob King justly holds against the said Jesse Newby, Jr. for the sum of three hundred dollars, said note being each date with this instrument due the 25th day of December next hath bargained and sold and doth by these presents bargain, sell, alien, convey and confirm to the said Jacob King a certain negro man named Tom, age about twenty-seven years old, also a certain negro woman named Nancy, aged about twenty years old, and her three children Henry, Green, and Crawford. Henry about seven years, Green about four, and Crawford about one. To have and to hold an and singular the right and claims to the said negroes, unto the said Jacob King, his heirs, executor, administrators or assigns forever in fee simple and I the said Jesse Newby, Jr. doth warrant and will forever defend the right and title to said negroes in to wit a man Tom, and a woman Nancy and children Henry, Green and Crawford and all to be ?? and ?? against the claim of all any person or whosoever. Subject nevertheless to this condition that if the said Jesse Newby, Jr. shall, will and truly pay to said Jacob King the amount of the principal and interest of the aforesaid note together with the cost which may occur thereon, then this deed of mortgage as well as said note shall be null and void otherwise to remain in full force and virtue in law.
