All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Paula Whatley Matabane pmatabane@bellsouth.net February 20, 2009, 5:19 pm Written: July 10, 1823 Ebenezer and Harriet Smith - Stephen Duke District 10, Lot 3 land sale Monroe County, GA Pike County, GA Deed Book A, page 38 July 10, 1823 This indenture made the tenth day of July in he year of our Lord one thousand eight hundred and twenty-three between Ebenezer Smith and Harriet, his wife, of said county [Monroe] and state of the first part and Stephen Duke of Pike County of Pike County and state aforesaid of the second part, Witnesseth that the said Ebenezer Smith and Harriet, his wife, for and in consideration of the sum of five hundred dollars to them in hand paid by the said Stephen Duke at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged and thereof and of and from every part or parcel thereof Ebenezer Smith and Harriet, his wife, do acquit, release, and discharge the said Stephen Duke , his heirs, executors, and administrators by these presents they the said Ebenezer Smith and Harriet, his wife, have granted, bargained, sold, aliened, remised, released and confirmed and by these presents do grant, bargain, alien, remise, release and confirm unto the said Stephen Duke and to his heirs and assigns all that tract or parcel of land lying and being in the state of aforesaid in the tenth district of Pike County on plan of said district by the number ten containing two hundred two and one half acres in the same more or less together with all and singular the house and houses, edifice, building, stables, yard, gardens, liberties, privileges, basements, commodities, emoluments, heriditaments rights, members and appurtenances whatsoever belonging or in anywise appertaining and the reversion s remainder and remainders rents ipues??? and profits and all the estate right- interest or in equity of Ebenezer Smith and Harriet, his wife, of in or to the same or any part or parcel thereof within the appurtenances to have and to hold the said tract of land and all and singular other the premises hereby granted, bargained, sold, aliened, and conveyed with the heriditaments to the only use and behoof of the said Stephen Duke, his heirs and assigns forever and to and for no other use, interest or purpose whatsoever and lastly the said Ebenezer Smith and Harriet, his wife, and their heirs the said tract of land and premises unto the said Stephen Duke, his heirs and assigns against Ebenezer Smith and Harriet, his wife, their heirs and against all and every other person or persons whatsoever shall and will arrant and forever defend by these presents in witness whereof the said Ebenezer Smith and Harriet, his wife, now unto set their hands and seals the day and year first above written. Ebenezer Smith Harriet Smith Sealed and delivered in presence of us John Stitiwell, JP Hickman Probate I, Harriet Smith, the wife of Ebenezer Smith, do declare that I have fairly and without any compulsion signed, sealed and delivered the within instrument of writing paper between Ebenezer Smith and Harriet, his wife, and Stephen Duke and I do hereby re----? all title or claim forever that I might claim or be entitled to after the death of Ebenezer Smith, my said husband, to or of out of the lands or tenements herein conveyed.
