To the Ordinary of said county: The petition of John W Mangham respectfully showeth that Franklin Brown resident of said County, departed this life on the 27th day of September 1878, leaving your petitioner as his next of kin, and also leaving a large estate of real and personal property, worth the sum of seven hundred dollars and at the time of his death the said Franklin Brown was entirely intestate, as your petitioner believes and herein allege: Wherefore, he prays the usual citation in such cases to issue, in order that he may obtain permanent Letters of Administration on Said estate, and your petitioner will ever pray. John W Mangham this 4th November 1878 Upson Court of Ordinary November Term the 4th 1878 The above petition of John W Mangham that he may obtain Letters of Administration, having been read, and considered by me, ordered that the usual citation issue. Amos Worrill Ordinary The Upson County Court of Ordinary December Term 1878 Citation having been duly issued and published, requiring all and singular the next of kin and creditors of Franklin Brown deceased, late of said County, to appear at this term, and show cause, if any they could, why permanent Letters of Administration should not be granted to John W Mangham of said County, and the parties so cited making no valid objection in the premises: It is ordered by the Court that Letters of Administration issue to John W Mangham as Administrator of Franklin Brown decd upon his giving bond and security in the sum of Fourteen hundred Dollars, and taking the usual oath of office. Georgia, Upson County} Regular December Term Court of Ordinary 1878 Upon the application of J W Mangham Administrator of the estate of Franklin Brown deceased for leave to sell the perishable property of said Estate. It is therefor ordered that the said Administrator have leave to sell the personal property of said deceased's Estate, giving ten days notice in terms of the Law. A Worrill, Ordinary State of Georgia, Upson County, } We J W Mangham R S Tisinger & E T Tisinger as securities of both the State and County aforesaid acknowledge ourselves held & bound to Amos Worrill Ordinary of said County, & his successors in office in the sum Fourteen hundred dollars subject the following conditions. The conditions of the above obligation are these----Whereas said John W Mangham hath this day been appointed Administrator of the Estate of Franklin Brown deceased, late of said County, and Letters of Administration having issued to him, Now, should the said J W Mangham make a true and perfect inventory of all and singular, the goods, chattels and credits of the said deceased, which have or shall come to the hands, possession or knowledge, of the said J W Mangham or into the hands or possession of any other person or persons for her; and the same aso (sic-also) made, do exhibit to the Court of Ordinary, when she shall thereunto be required; and such goods chattels and credits, do well & truly administer according to law. And do make a just and true account of his actings and doings therein, when lawfully thereunto required, by any court of said County; and all the balance of the goods chattels and credits which shall be found remaining upon the account of said Administration (the same being first all owed by the said Court of Ordinary) shall deliver and pay to such persons, respectively as are entitled to the same by law. And if it shall here after appear that any last will & testament was made by the deceased, and the same be approved, according to the law, the Executor obtain a certificate of probate thereof; and the said J W Mangham do such case if required, render & deliver up the said Letters of Administration, then this obligation to be void, otherwise of force. Thos F Bethel Mortgage Deed No. 7 State of Georgia, Upson County This indenture made this eighteenth day of May in the year of our Lord One thousand eight hundred and seventy six between Franklin Brown of the County of Upson and State of Georgia of the one part, and Thomas F Bethel of the County of Upson and State of Georgia of the other part: Witnesseth, That the said Franklin Brown hath made and delivered to the said Thomas F Bethel his certain Promissory Note subscribed with his hand and bearing date as herein stated to wit: his note for $114.40 one hundred and fourteen 40/100 dollars dated 18 May 1876 and due one day after date with interest from the first of January last at 10 per cent whereby the said Franklin Brown hath promised to pay the said Thomas F. Bethel the sum of one hundred & fourteen 40/100 dollars for value received. Now, for and in consideration of the sum of five dollars, by the said party of the second part, to the said party of the first, in hand paid, the receipt whereof is hereby acknowledged, as well as for the better securing the payment of the aforesaid promissory Note, the said Franklin Brown hath granted, bargained and sold, and doth by these presents grant, bargain and sell unto the said Thomas F Bethel his heirs and assigns, the following Property to wit: the undivided half of Lot of land number one hundred and eighty three in the sixth district of Carrol County being one hundred acres more or less hereby waiving all right to homestead exemption and bankruptcy to said property and further hereby give to said Thomas F Bethel irrevocable authority to object by plea or otherwise to any application that may be made by any person to Homestead Exemption or Bankruptcy to said property in my name and this shall be proof of my objections. To have and to hold said bargained Property to the said Thomas F Bethel his heirs and assigns, to their own proper use, benefit and behoof, forever. And the said Franklin Brown for his heirs, executors, and administrators, the said bargained Property unto the said Thomas F Bethel will warrant and forever defend against the claim of himself and his heirs, and against the claim of all other persons whatever. Provided, nevertheless, that the said Franklin Brown his heirs, executors or administrators, shall and do well and truly pay or cause to be paid unto the said Thomas F Bethel his heirs and assigns, the sum of money in said Note specified, and interest that may accrue thereon, on the day, and at a time mentioned and appointed for the payment thereof, in the said Promissory Note mentioned, with lawful interest for the same, according to the tenor and effect of said Note then and from thenceforth, as well this present Indenture, and the right to the said Property, thereby conveyed, as well as the said Promissory Note shall cease, determine, and be void to all intents and purposes. A Worrill, Ordinary Petition of J W Mangham for the appointment of appraisers to set apart 12 months support to the Widow of Franklin Brown decd Filed in office September 23rd/82 A Worrill Ordinary Recorded in Minutes G page 12 A Worrill Ordiny Georgia Upson County To the Hon Ordinary of said county: The petition of J W Mangham Adm Est Franklin Brown decd in behalf of Martha Brown widow of said deceased showeth that Franklin Brown died on the 27th day of Sept 1878 and that he left the said Martha Brown widow of ________ and Petitioner further showeth that it would be for the best interest of said widow that a commission be appointed to set apart twelve months support & sufficient furniture out of said estate for her comfort and support this 23d Day of September 1882. It is therefore ordained that I H Traylor, J W Jones, D R Womble, C H Collier J F Black be and they are hereby appointed commissioners to set apart in terms of the law 12 months support for said widow. Twelve months support set apart for the widow of Franklin Brown Record in Inventory and appraisement book A Folio 16 A Worrill Ordny State of Georgia, Upson County By the Court of Ordinary for the said county To J H Trayler, J W Jones, D R Womble, C H Collier and J F Black Esquires, Greeting: These are to empower you or any three of you to set apart and assign to the widow, or widow and minor child or children, (if such there be), or minor child or children only, if there is a widow, of Franklin Brown deceased, either in property of money, a sufficency from the estate of said deceased, for her, his or their support and maintenance, for the space of twelve months, (from the date of administration, in case there is administration on the estate,) to be estimated acccording to the circumstances and standing of the family previous to the death of the testator or intestate, and keeping in view also the solvency of the estate; but in no event less than one hundred dollars. If there be a widow, also set apart, for the use of herself and children, a sufficent amount of household furniture. If, on a just appraisement of the estate, it does not exceed $500.00, you shall set apart and assign the whole of it to the widow and minor child or children; or if no surviving widow to the lawful guardian of the child or children, for their benefit. It is your duty to make a schedule of the property set apart by you, and return the same under your hands and seals to the Ordinary of said county, within the time prescribed by law. If there are two sets of children by different wives, you shall specify in said schedule the portion going to the children of the deceased wife. You, and each of you, before entering upon the discharge of your duties, shall take and subscribe an oath to faithfully discharge your duties, before some officer authorized to administer it, or before one of your number, which oath, together with a certificate of your having taken the same, shall be returned with said schedule. Amos Worrill Upson County} We as Commissioners appointed to set aside a year's sufficient for the widow of Franklin Brown deceased fine only 100 acres of land in the 15th dist of Upson County and about twenty five dollars of old furniture from which to obtain said support we therefore value it at three hundred dollars and recommend that it be applied for the support of the widow of the said Franklin Brown decd.
