And will of Ella D. Colquitt
Upson County Ga.

Last Will And Testament of John F. Colquitt State of
Georgia, County of Upson.

I, John F. Colquitt, of said state and county, being
of sound and disposing mind and memory, do make this
my last will and testament, hereby revoking all
wills heretofore made by me.

Item 1- I wish my executor, as soon as possible
after my death, to pay my debts.  If a sale of
property shall be necessary, I wish her to select
for sale that which can be most advantageously used
for that purpose, and I authorize her to sell the
same at public or private sale as she may see fit.

Item 2- I give to my daughter in-law Mrs. Pearl
Colquitt, and her two children, Mattie Kate and
Willie Pearl Colquitt the sum of two thousand
dollars, which is to be equally divided between
them.

Item 3- I give to my beloved wife Mrs. Ella D.
Colquitt, for and during her natural life all my
real estate and personal property of every kind and
character, said real estate consists of about one
hundred and forty acres of land of lots Nos. 146 and
161 in the tenth district of Upson county, Georgia
being the place on which I now reside on the East
side of Thomaston and Barnesville public road 2½
miles North East of Thomaston, Georgia, and bounded
as follows:  North by John B. McGee’s land, East by
lands of Mrs. Regina McKenny:  South by lands of
Mrs. Ella D. Colquitt and J. H. McEachern and West
by said public road.  At the death of my said wife
all said property shall become the property of and
be equally divided between my children and a childs
part shall become the property of  my daughter in-
law, Mrs Pearl Colquitt and her two children to wit,
Mattie Kate and Willie Pearl Colquitt, Jointly.  If
either of my children should die leaving a child or
children, the share of such deceased child shall go
to his or her child or children.  The foregoing
provisions for my said wife is intended in lieu of
dower.  Said personal property consists of live
stock, crops, money, shares in Cooporation and other
things.

If a sale of any of said property for distribution
should be necessary I authorize my executor to sell
the same at public outcry without an order of court.

Item 4-  I do hereby appoint Mrs. Ella D. Colquitt
Executor of this my will. In testimony whereof I
have hereto set my hand this the 28th ., day of
November, 1916.

will and testament in the presence of the
undersigned who subscribe our names hereto as
witnesses at the instance and request of said
testate and in his presence, and in the presence of
each other.

This the 28th., day of November, 1916.

State of Georgia.
County of Upson
		
I, Ella D. Colquitt, of said state and county, being
of sound and disposing mind and memory, do make this
my last will and testament hereby revoking all wills

Item 2-  I give to my beloved husband, John F.
Colquitt, for and during his natural life all my
real and personal property of every character, kind
and description.  Said real estate consists of
Ninety three (93) acres of land of lot No. 146 in
the 10th district of Upson County, Georgia, bounded
as follows:  North by lands of J. F. Colquitt:  East
by lands of Mrs. Regina McKinney:  South by lands of
L. P. McCoy and T. R. McKindley, and West by lands
of J. H. McEachern and J. F. Colquitt.  Also any
other land I may hereafter acquire.  At the death of
my said husband it is my will and I so direct that
all said property shall become the property of my
children, share and share alike the share of my
deceased son Willie B. Colquitt shall become the
property of my daughter in law, Mrs. Pearl Colquitt
and her two children to-wit, Mattie Kate and Willie
Pearl Colquitt.  If either of my Children should die
leaving a child or children I direct and will that
the share of such deceased child shall go to his
child or children.

Item 3.  If a sale of said property for distribution
or to pay debts should be necessary, I authorize my
executor to sell the same at public sale without
obtaining an order of court, after advertising the
same once a week for four weeks.

Item 4.  I do hereby appoint John F. Colquitt
Executor of this my will. In Testimony whereof I
have hereto set my hand this the 28th day of
November, 1916.

will and testament in the presence of the
undersigned, who subscribe our names hereto as
witnesses at the instance and request of said
testatrix, and in her presence and in the presence
of each other, This 28th day of November, 1916.

Codicil To John F. Colquitt’s Will
Georgia, Upson County.

Whereas, I, J. F. Colquitt, did on the 28th,. Day of
November, 1916, sign, seal, declare and publish my
last will and testement, in the presence of C. P.
Stephens  W. S. Johnston and M. L. Kelly who signed
the said will and testament as witinesses:

And Whereas, I am desirious  of making certain
changes in my said will, I therefore, make and
publish this codicil to said will and make the
following changes in the contents thereof.

I hereby strike from my original will, Item Two (2)
thereof, which gives to my daughter-in-law, Mrs
Pearl Colquitt, and her two children, Mattie Kate
and Willie Pearl Colquitt, , and her two children ,
Mattie Kate and Willie Pearl Colquitt, the sum of
Two Thousand Dollars (2,000.00) in lieu of said
bequest, I am this day executing to Mrs. Pearl
Colquitt a deed to certain lands located in the
Tenth District of Upson County, Georgia.

By substituting in item four (4) the name of  J. T.
Colquitt as Executor of my Will in place of Mrs.
Ella D. Colquitt, the named executor.

In Witness Whereof, I have hereunto set my hand and
seal this 8th., day of July, 1937.

Colquitt as his last will and testament in the
presence of us, the undersigned, who subscribe our
names hereto in the presence of said testator, after
he had signed his name thereto, and at his special
instance and request, and in the presence of each
other.
