Ferguson Whereas, Mrs. Hexie Ferguson, late of the county and State aforesaid, now deceased, died intestate, having whilst she lived, and at the time of her death, real and personal estate within the county and State aforesaid, by means whereof the full disposition and power of granting the administration of all singular, the real estate of said deceased, and also auditing the accounts, calculations and reckoning of the said administration, and a final dismission of the same, to this Court is manifested known to belong: I, desire that the real and personal estate of said deceased, may be well and truly administered, converted, and well disposed of, do hereby grant unto the said C.A. Ferguson, Full power by the tenor of these presents to administer the real and personal estate of said deceased which to her in her lifetime, and at the time of her death, did belong; and ask, levy, sue for, recover and receive the same; and to pay the debts in which the deceased stood obligated, so far forth as her real & personal estate will extend, according to their rate & order of law; being first sworn on the Holy Evangelists of Almighty God, to make true and perfect inventory thereof, and to exhibit same unto the Court of Ordinary aforesaid, in order to be recorded, on or before the 3rd day of August, 1937 next ensuing, and to render a just true account, calculation, and reckoning of said administration, when thereunto required: And I ordain, depute, and Constitute you, the said C.A. Ferguson Administrator of all and singular the real and personal estate of the said deceased. Witness the Honorable J. M. Ordinary of said County: The petition of C. A. Ferguson shows that he is the Father of Mrs. Martha Ferguson Howell, age 19 years, and Ben T. Ferguson, age 11 years, minors, residing in said County; that said minors have an Estate of probably $500 coming to them from MRS. HEXIE FERGUSON'S Estate. Petitioner prays an order appointing him Guardian to the property and said Minors C. A. Ferguson, Petitioner ORDER Upson COURT OF ORDINARY OCTOBER 4th 1937 Upson reading the petition of C.A. Ferguson, the father of Mrs. Martha Ferguson Howell And Ben T. Ferguson it is ordered that the said C. A. Ferguson be, and he is hereby appointed Natural Guardian of the property of said minors and the he is hereby appointed Natural Guardian of the property of the said minors and that he give bond and security as required by law, in the sum of $1000.00 and take and subscribe the oath as required by law of such guardians. Middlebrooks Ordinary Filed in Office October 4th, 1937 Georgia, Upson Co., To the Ordinary of Said County: The petition of C.A. Ferguson, Gdn. of Martha Howell Ferguson and Ben T. Ferguson, minors respectfully shows: 1. That certain funds have been paid and will hereafter be paid to him as guardian from the Estate of Mrs. Hexie Ferguson, his wards being heirs of said Mrs. Hexie Ferguson. 2. That the income from said Estate of his wards is sufficient for their support and it will be necessary for petitioner to encroach upon the corpus of the estates of his said wards for their support and maintenance and to pay other legal charges against said estate. 3. That due to the small amount of said estates, it may be impractible for petitioner to invest same in legal securities, and if so, it will be for the best interest of the said estates to deposit the funds of said estates on savings account in the Citizens & Southern Bank of Thomaston. Wherefore, petitioner prays: (1) that he be authorized to encroach upon the estate of his ward MARTHA FERGUSON HOWELL in the sum of $30.00 per month for her support and maintenance, and also in such additional amount or amounts as may be necessary to pay the cost of administration and any other legal charges against her estate. (2) That he be authorized to encroach upon the estate of his Ward BEN T. FERGUSON in the sum of $15.00 per month for his support and maintenance, and also in such additional amount or amounts as may be necessary to pay the cost of administration any other legal charges against his estate. (3) That petitioner be authorized to deposit any surplus money of said estates on savings account in the Citizens & Southern Bank of Thomaston, whenever he deems same for the best interests of said estate, and that he be relieved of all liability and for interest thereon other than as collected on such deposits. Middlebrooks, Ordinary Law Offices DALLAS & HOLLIMAN W.M. Dallas Thomaston, Ga. Order of Court Upson Court of Ordinary February Term 1938 The foregoing petition read and considered; ordered, that said guardian be and he is hereby authorized to encroach upon the corpus of his Ward's, Martha Ferguson Howell's estate, in the sum of $30.00 per month to be paid or expended for said ward for her support and maintenance and to further encroach upon the corpus of her estate in whatever amount is necessary to pay the expenses of administration and other legal charges against her estate. Ordered further, that said guardian be and he is hereby authorized to encroach upon the corpus of his ward's, Ben T. Ferguson's estate, in the sum of $15.00 per month to be paid expanded for said ward for his support and maintenance and to further encroach upon the corpus of his estate in whatever amount is necessary to pay the expenses of administration and other legal charges against her estate. Ordered further, that said guardian be and he is hereby authorized to deposit and surplus funds on which he is or may hereafter be chargeable with interest, on savings account in the Citizen's & Southern Bank of Thomaston, and that he be relieved of any liability for interest thereon, other than that collected from said bank.
