All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm *********************** This file was contributed for use in the USGenWeb Archives by: Pauleta Hicks pauleta@cctc.net State of Georgia} Upson County} In the name of God, Amen, I, Samuel Hicks of said county taking into consideration the uncertainty of this mortal life and being of sound and perfect mind and memory do make and publish this my last Will and Testament hereby revoking all former Wills by me made, and first I direct that my body after death be decently buried and to my worldly estate, I dispose of the same as follows- Item first; I direct that all my just debts and funeral expenses be paid out of the first monies that shall come into the hands of my executors and executrix from any portion of my estate real and personal. Item second; It is my will and desire that after my death my plantation be kept up and the whole of my property real and personal be kept together as the common property of my wife and two children until such time as in the opinion of my executors and executrix it may be thought best to do otherwise or until my wife or either or my children may get married or either of said children arrives to the age of twenty one years. Item third; So soon after my death as in the opinion of my executors and executrix it may be thought best to do so, or so soon as my wife or either of my children may get married or either of said children arrives to the age of twenty one years, I wish the whole of my estate real and personal, together with the profits and increase from the same up to that time, with the exception of my negro girl child about three or four years of age of yellow complexion and by the name of Jane; be divided into three shares or portions of equal value; one of which shares or portions I hereby give and bequeath to my wife Louiza Hicks her heirs and assigns forever. Another of said shares or portions, I hereby give and bequeath to my son Thomas B. Hicks his heirs and assign forever-and the other of said shares or portions together with said Negro child Jane I wish to be kept by executors and executrix for the sole use of my daughter Mary Elizabeth Hicks until she gets married or arrives to twenty one years of age when I wish the right and title to the same with the profits and increase from the same to go to and be vested in my said daughter for her sole and separate use and benefit of herself her heirs and assign forever with the full right and power to dispose of the same by deed, will or otherwise as she may choose or think proper. And I expressly state it to be my will and desire that no part of said property so provided for my daughter be ever subject to the payment of the debts of any husband to whom she may be married and in no manner be liable or subject to be sold or disposed of by any such husband as his property. I do hereby make and appoint my Brothers in Law- Xenephon Bowdre and William D. Woodson Executors and my wife Louiza Hicks executrix of this my last Will and Testament. Birdsong being duly sworn depose and say that they saw said Samuel Hicks the Testator, sign, seal and declare and publish the within instrument as his last will and testament freely, voluntarily and of his own accord and without any compulsion or influence whatever. James Flynn, J.P. ========================== DISTRIBUTION OF ESTATE OF SAMUEL HICKS Dec. 16, 1858 Upson County, GA State of Georgia Upson County By virtue of an order form the honorable Court of Ordinary of said conty on the first Monday in December "instant" to us directed, authorizing and requiring us to make distribution of the Estate of the late Samuel Hicks, deceased. Among the distributors entitled to said estate we proceeded this day to the performance of that duty. There were three distributees, to wit, Louisa Hicks widow of said Samuel Hicks, decd., Thomas B. Hicks, son of said Samuel Hicks decd of full age, and Dana L. Brown who is intermarried with Mary E. Hicks, the daughter of said Samuel Hicks, decd. The shares were numbered 1-2-3 and were assigned to the distributees in the following manner, to wit--share No. 3 was assigned to Louisa Hicks, the widow of her choice. The names of the other distributees were palced in a hat--the numbers 1 & 2 were placed in another hat--the hats were both well shaken, a name was drawn from the hat containing the names, then a number was drawn from the hat containing the numbers until all were drawn. The following is the result: No. 1 to Dana L. Brown No. 2 to Thomas B. Hicks No. 3 to Louisa Hicks No. 1 consisted of Charles, a man, Rachael a woman, Fanny a woman & her infant child, Robert & Charlie, boys & Frances & Lucy girls valued to $5000.00. Sandwich ================== I've attached a variety of transcribed papers regarding the estate of Samuel Hicks, died 1852 Upson: his will, the appraisal of his estate 1852, the distribution of his estate 1858. The slaves that he owned at the time of his will are named by first names and they are also named in the appraisal & distribution plus their "market value". In a separate email I will send you via attachment the 1850 Upson Co. slave schedule for Samuel Hicks plus the 1860 slave schedules (Upson) for the inheritors of his estate. Samuel Hick's will is interesting in that he acknowledges his Negro daughter, Jane, age 3-4 years old of yellow complexion. IN his will he leaves Jane to his white daughter, Mary Elizabeth Hicks, a minor. Samuel's executrix (his wife, Louisa Bowdre Hicks) is to care for Jane until Mary Elizabeth marries (she did 1857 Upson to Dana L. Brown) or turns 21. In 1858 there's a document specifically mentioning the delivery of Jane from Louisa Hicks (Samuel's widow) to Dana Brown for his wife formerly Mary E. Hicks through his agent, Thomas A. Brown. Dana Brown and his wife, Mary Elizabeth Hicks Brown, were in Titus Co. TX for the 1860 census and he's on the 1860 slave schedule there with 9 slaves, 8 mulattoes and 1 black. I will attach this TX slave schedule next email--it might help somebody in tracing their slave ancestors from Upson Co.
