Kimball Entered on Minutes Court of Ordinary Oct. Term 1862 Georgia, Upson County To the Court of Ordinary of said County October term 1862 The petition of Elizabeth Kimball respectfully sheweth that here before, to wit, on the third day of May, 1861, Elbert N. Kimball being then in life & resident in said County of Upson signed, sealed , declared & published an instrument in writing in the presence of E. B. Atwater, John W. Atwater & George W. Davis, who subscribe the same at witnesses as his last will & testament, that shortly after executing said instrument, the said Elbert N. went in the Army of the Confederate states as a soldier, in a Company commanded by Capt. Thomas Beall, [Co K 5th Regiment] known as the Upson Guards, and died at WestPoint, Ga. on or about the 14th day of August 1862, being on his return home & being discharged and your petitioner further shows that she is the sister of said Elbert N. Kimball, residency is said County of Upson and is of lawful age, and that she is the executrix nominated & appointed in said Will. Wherefore she brings said Instrument now into Court & pronounces the same for probate, and that the same may be Proved & accepted as the Will of Said Elbert and that Letters testamentary may issue to her in the provings.
