Will of Daniel Parker 15 Dec 1840 Upson County, GA Contributed by martha@arc.net. Martha Lackey Georgia Upson County I, Daniel Parker, of the State and County aforesaid being weak and feeble though of sound mind and menory do make and ordain this my last Will and Testament in manner and form following Viz: Item 1st. I give and bequeath unto myu wife Lucy, the following property to wit, Peter, Nelson and Tamer, one mare mule called Nell, one sorrel mare, two cows and calves, one road wagon, one yoke of oxen, twenty-five head of hog first choice, the flock of sheep, all the household and kitchen furniture, cotton gin and running gees, fan and threshing machine, ny new carryall, plantation tools and one year's provision. All this I give and bequeath to my wife, her lifetime, and then to be equally divided between my children. Item 2d. Mary Hudman has received Five hundred dollars in part of her legacy of my estate. Item 3d. Nancy Meadows has received Four hundred twelve and a half dollors in part of her legacy of my estate. Item 4th. Faytha Dark has received Three hundred Eighty Seven and a half dollars in part of her legacy of my estate. Item 5th. Stephen Parker has received Six hundred Ninety two and a half dollars in part of his legacy of my Estate. Item 6th. Daniel Parker just has received Six hundred Ninety two and a half dollars in part of his legacy of my Estate. Item 7th Philoman Parker has received Six hundred Ninety two and half dollars in part of his legacy of my Estate. Item 8th Sherwood Parker has had Six hundred Seventeen and a half dollars in part of his legacy of my Estate. Item 9th. Lucy Parker has had two Ben and Cow and calf in part of her legacy of my Estate amounting to thirty seven dollars and a half and I also give and bequeath unto the said Lucy, Amos, a negro man over and above and equeal proportion with the rest of the Legatees. Item 10th. Thomas Parker has had Six hundred seventeen and a half dollars in part of his legacy of my estate. Item 11th. Susannah Meadows has had Four hundred eighty seven and half dollars in part of her legacy of my Estate. Item 12th. And when each of the Legatees part is made up equal to the highest then the balance of my Estate to be equally divided among my children. Item 13th. I constitute, nominate and appoint William Trice and Septha F. Walker my sole Executors of this my last Will and Testament hereby revoking all other and former Wills by me at any time heretofore made. In Witness whereof I have hereunto set my hand and seal the Fifteenth day of December in the year of our Lord One Thousand Eight hundred and forty. Hansford and Jonathan Colquitt two of the subscribing witnesses to the within Will, having come into open Court and being duly sworn deposeth & saith that they saw Daniel Parker sign by making his mark seal publish & declare the foregoing instrument as being his last Will & Testament that they subscribed the same as witnesses and Allen Ware do so likewise. The last Will and Testament of Daniel Parker Gen. deceased having been proven in open Court by Jonathan Colquitt and Charles P. Hansford two of the subscribing witnesses thereto.
