Smith bcsga@yahoo.com http://files.usgwarchives.net/ga/upson/wills/vining.txt John Vining’s Will In the name of God Amen: I John Vining of Upson County in the state of Georgia do hereby make and declare this to be my last will and testament. I give and bequath to my wife Elizabeth Vining, my daughter Emaline C. Vining, my son William W. Vining, my daughter Levina K. Vining, my son John S.B.Vining, my daughter Epsibah P. Vining, my son Frances J. Vining and also my wife now apparently being in a state of Pregnacy should she live to bring forth a living child or children from her present pregnacy, I wish it or them as the case may be all jointly and equally to share in the following property. (viz) Lot of land I now live on known by number one hundred and eighteen (118) and lot of land one hundred seventeen (117) each containing two hundred two and half acres more or less, both in the sixteenth district of originally Houston now Upson and aforesaid state with all there appurtainonus, one lot of land in Irwin County number four hundred and fifty in the sixth district of said county, one lot in Aplin County known by number ninety six in the 5th District of said county and half of lot in Pulaska County known by number one hundred and twenty one in the twentyeth district of said county and lot in the Cherokee County known by lot number fifty four in the fifteenth District, third section. I give and bequath also a negro woman Sintha and her children and increase (viz) Julian a girl about twelve years of age, a boy Sam eight years of age, a boy Henry about two years of age together with all my house hold and kitchen and farming utentials and also all my stock of all discription (viz) Horses cattle hogs all to be kept together and to be managed to the best advantage for the benefit of the whole until my oldest daughter Emaline comes or arrives of age at the years of twenty one when I wish all my estate hertofore and what shall be here after named in my last will and testament to be laid off and equally divided in lots according to the number of heirs then a live and to be drawn of by a lotery of said heirs excepting that my wife, Elizabeth whom I wish to have the prefrence of choosing the House and lot laid of around it (viz) the said dewling where I now live and as each child comes of age I wish it to have the control of the portion of the estate which will be kept in trust by its guardian until that period---I also wish my negro man John to be sold and that he have the privilege of choosing his master provided my executors should be of opinion such purchaser is willing to pay a fair price for said John, if not to be sold by the exectors to any other person whom they deem most advantagious to the heirs. I also wish all my land excepting the two lots where I now live (Viz)numbers one hundred and eighteen and one hundred and seventeen both in aforsaid state and county—which I wish to remain unportion or undivided as hereto stated until the oldest child becomes of age—the balance of my land I wish all to be sold and money that they shall bring with the money that my negro man john shall bring to be kept out on interest for the benefit of the schooling of my children until there shall be a division which is above mentioned will do give and bequest to my above named heirs and there heirs and asignes for ever—I do herby nominate constitute and appoint my trusty friend John G. Starling, Zachariah H. Gordon, Davis H. Starling executors of this my last will and testamint: In witness whereof I have herento set my hand and seal this the sixth day of October in the year of our Lord eighteen hundred and thirty five.
