All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Diane Caldwell power2000@gnat.net August 8, 2004, 7:30 pm Source: Will Book Upson Co Written: May 29 1838 Recorded: September 1839 The Last Will and Testament of Joseph Baldwin Georgia Upson County I Joseph Baldwin of the County and State aforesaid being of sound mind and disposing memory do make and ordain this my last will and testament in manner and form as follows - First: My will and desire is that my Executor (herein after remain) keep all my Estate together work the negroes on the plantation and out of the proceeds of the crops, pay all my just debts educate and defray the necessary expenses of my children until they arrive at lawful age or marry. Second: When each of my children (i.e) Augusta T. Baldwin, Ann Eliza Baldwin, Mary Jane Baldwin, Benjamin J. Baldwin, and George S. Baldwin arrive at lawful age or marry. It is my will and desire that they receive two negroes each nearest their own age. One male and one female, that may be sound and healthy together with such outfits of household and kitchen furniture, stock &c as my executor my think right & proper, so that they all receive an equal amount in value of the last named property. My Executor may also if she thinks it best to do so give one or more small negroes to each of my above named children of size suitable to nurse or to be of other service, so that such division shall be of equal value to each one of my children above named. Third: The residue of my Estate both real and personal I lend to my beloved wife Mary W. Baldwin during her natural life or widowhood. Fourth: I do hereby appoint my beloved wife Mary W. Baldwin sole executor of this my last will and testament during her natural life or widowhood, but should her death or marriage take place before all my children heretofore named arrive at lawful age or marry. I do hereby appoint my friend Dr. David Kendall Executor of this my last will and testament, and guardian of such of my children as may be unmarried or under lawful age. Fifth: It is my will and desire that my Executor above named my exercise her own discretion in selling and buying; or otherwise disposing of any of my property real or personal as she may consider best for her own comfort or the benefit of my Estate - and that the proceeds of sale, be again laid out for similar property or be loaded at interest. Sixth: It is my will and desire should my beloved wife depart this life before all my children heretofore named arrive at lawful age or marry, that my negroes be equally divided between all my children as above named and to residue of my Estate bot real and personal be sold by Executor on such terms as he may think best for the interest of my Estate, and the funds thence arising as well as such as may arise from the hire of negroes be loaned out to the best advantage, and out of the interest arising from said funds. I wish my children which may br unmarried and underage to be educated and supported until they arrive at lawful age or marry at which time, I wish said fund to be equally divided between all my children heretofore named. Seventh: It is further my will and desire that should my beloved wife marry again, she receive One sixth part of my Estate in fee simple, and then in that case that the residue of my Estate be disposed of as directed in the proceeding or sixth item; Annulling and revoking all other wills or testaments heretofore made by me, I have hereto set my hand and affixed my seal the 29th day of May 1838 (Signed) Joseph Baldwin In the presents of D.
