I Green Hawk of said county and state being of sound and disposing mind and memory do make this my last will and testament hereby revoking all wills heretofore made by me. Item 1st I wish my executors as soon as possible after my death to pay my debts at a sale of property Should be necessary I wish him to Select for sale that which can be most advantageously used for that purpose and I authorize him to sell the same at public or private sale as he may [see] fit without any order of the court or ordinary Whatever. Item 2nd In case my beloved wife Lavinie Hawk shall survive me I give, devise and bequeath all the rest, residue and remainder of my estate real and personal whatsoever and wheresoever situated to my said wife Lavenie Hawk during the residue of her natural life. Item 3rd On the death of my said wife it is my will that all of my estate both real and personal be sold and the proceeds be equally divided into as many equal parts or shares as I may have children and the Lawful issue of any other child or children who may have died before me leaving lawful issue. Such issue of a deceased child together representing their father or mother as the case may be in such division provided that before the division is made I devise That all the shares may be made equal by each child accounting fully for whatever property or money I may have given him or her prior to the execution of this will. I have advanced to my son Rufus one hundred Dollars and to my son John one hundred and ten Dollars and it is my will that these sums be also accounted for fully together with interest at 8 per cent per anun from October 12, 1905. Item 4th I do hereby appoint B S Walker executor of this my last will and testament and it is my will that he be relieved of making any bond as such executor and also be relieved [from making] any returns to any court of his receipts ________ actings and doings as such executor. It is my [will] that my beloved wife remain upon and keep in charge of my farms during her life and that my sons Williams and Cornelius send to her such assistance as she may require in the management Witnesses Cliford Walker J N Hughes Green Hawk W. McConnell Of said farm during her life In witness whereof I have set my hand this 12th day of Octobre 1905 Green Hawk Signed and published by Green Hawk as his last will and testament in the presence of the undersigned. Who published our names hereto as Witnesses at the instance and request of said testator. And in his presents and in the presense of each other This the 12th day of October 1905 Clifford Walker J N Hughes W O McConnell Georgia Walton County, Whereas I Green Hawk did on the 12th day of October 1905 sign seal declare and publish my last will and testament in the presence of Clifford Walker J N Hughes and W O. McConnell who signed the said will and testament as witnesses and whereas I am now desirous of making certain changes in said will I therefore make and publish this codicil to said will and testament. Item 1st Having advanced to my son Rufus the further sum of Two hundred and Fifty Dollars it is my will that he do not recive any further amounts from my estate but that the al[lot]ments made to him be in full of all his ____ in my estate. That my executors after deducting said advancements from the share of the proceeds his [sic] shall pay the remainder of said share to my grandson Roy and my Grand Daughter Valenia Mary children of Rufus Hawk as follows. The proceeds of said share to be equally divided among said children until Valenia Mary becomes twenty one years old When said share shall be divided giving two thirds to Roy and one third to Valenia Mary. Item 2nd My son John having died sense making my will as aforesaid it is my will that his share be equally divided among my Grandchildren Lola Roseby/Rosely Magnolia Naomi and Effie, children of John Hawk, except that one Dollar be paid to Paschal Hawk in full of his share Item 3rd That is my will that Ardless and Green Hawk shall live with and assist my wife in the management of my estate during her life as my sons William and Cornilius have become of age and left home since making my will as above mention Green Hawk Signed and published by Green Hawk as a codicil to his last will and testament in the presence of the undersigned who subscribed our names hereto as witnesses at the instance and request of said testator and in his presents and in the presence of each other this March 1st 1912 Jno T. Robertson do swear that I as well as C N Medows and Orrin Roberts saw the within named Green Hawk sign & publish the within attested paper as his last will and testament we subscribed the same as witness thereto at the special instance & request of the said Green Hawk and in his presence as did also C N Medows and Orrin Roberts in the presence of ______ and of each other that the said Green Hawk signed the same freely & voluntary and was at the same time of such signing & sound & disposing mind & memory.
