LACKEY, wife of the said Noey Lackey, late of said county deceased, of the one part, and after legal Legatees, William LACKEY, P. E. STREET, Martha S. DORSEY, Netie A. FULLER, of the other part, witnesseth that the Legatee, William LACKEY, P. E. STREET, Martha S. DORSEY and Netie A. FULLER, agree on their part to pay fifty Dollars each of the indebtedness of the Estate of the said, Noey LACKEY, so soon as they can possibly do so, and the said Mary A. LACKEY, widow of said deceased, having by agreement of all the Legatees of age, taken charge of all the effects of said Estate including the Crop of the present year, assumed all the indebtedness of said Estate and agree upon her part when the compliance of the above named Legatees to see that good and sufficient titles are made to each of them to certain Tracks or Parcels of land upon which they reside of the land belonging to said Estate and that this agreement is gone in to, to save expense and to carry out as far as possible the intentions of the said Noey LACKEY deceased, and it is further agreed that the Land belonging to said estate are to be sold soon as possible and in order to make a division and perfect titles, and it is further agreed that the widow, Mary A. LACKEY, is to hold in her possession all the effects of said Estate after the debts are paid and the division made with the within named Legatees and including that part belonging to Mary A. (Superior Court) Georgia {October 18th 1880 Walton County {Whereas Noey LACKEY of said county on the 15th day of June 1880 died intestate leaving his widow, Mary A. LACKEY and Permelia E. STREET, wife of James M. STREET, Martha S. DORSEY, wife of Wm. C. DORSEY, John LACKEY, Netie A. FULLER, wife of Jesse L. FULLER, Mary Ann LACKEY, John LACKEY, Noah B. LACKEY, his children & only heirs at law entitled to share in the distribution of said estate according to the statute in such case made and provided and whereas the above named heir at law of said intestate have agreed that the land of said Noey LACKEY, be divided in kind, that the Personal Property of said estate is to go in the possession of Mary A. LACKEY, widow of deceased for the use of herself and the following children, Mary Ann LACKEY, John LACKEY and Noah B. LACKEY, they hereby waiving their rights to any allowance for 12 mos. Support to which they are entitled and any of their demand on said estate except what is expressly granted, the title to said personally to be in Mary A. LACKEY & then to advance to said last heirs mentioned an amount equal to advancements to older children. Now it is hereby agreed between all the parties that Wm. LACKEY, P. E. STREET, Martha S. DORSEY, and Netie A. FULLER shall pay the sum of fifty dollars each toward the settlement of the indebtedness of said estate and the balance of the liabilities of said estate is to be borne equally between the widow and the other thence remaining heirs that where said indebtedness is discharged the land to be divided in a manner and force to wit; that Permelia E. STREET, Martha S. DORSEY, William LACKEY and Neatie A. FULLER shall each receive from all the others besides himself of a warrantee deed to the different tracts or parcels of land upon which each has lived for several years and on which they now reside respectively, that said tracts comprise lot No. 395 in the 9th District originally Henry, now Walton County, that the remaining heirs at law to Mary A. LACKEY, John LACKEY, and Noah B. LACKEY, are to covert, possess, and enjoy jointly the following lot No. 408 in said district county each of which lots contains two hundred and two and half acres, more or less and to the end that this agreement be expected according to the intentions of the parties, said Mary A. LACKEY has acted as agent of the estate (of the estate) in the settlement of the indebtedness and said agency in here by ratified and confirmed the same as if the undersigned personally did the same. And it is mutually understood that this is a final disposal of the entire estate of said deceased and that they are mutually bound to each other for and any such amatiors(?) of demand by Noey B. LACKEY in said estate in case any proceeding should be instituted and carried to final judgment as his favor, by reason of his minority and by consent to in disposition of said estate. And it is further agreed that the lot No. 408 in said county and district be accepted in the division of land as the property of Mary A. LACKEY, the widow and the following children, Mary Ann LACKEY, John LACKEY, and Noey B. LACKEY. And Mary A. LACKEY is to receive lot No.1. Mary Ann LACKEY is to receive No.2, Noey B. LACKEY is to receive No.3 & John LACKEY is to receive No.4, each of said last mentioned heirs agreeing and causing to an equal division and each to have a deed from all, the Balance of the heirs representing Noey B.
