In the name of God Amen. I Martin Turman of the county of Walton and state of Georgia being weak in body but of sound mind and memory thanks be to God do make this my last will and Testament. First of all I recommend my soul to God who gave it. My body to the dust to be buried in a decent manner, by my Executors hereafter mentioned, and as to my worldly estate I divide as follows, viz. Item, I give and bequeath unto my Daughter Molly Hailey one dollar. Item, I give and bequeath to John Termans heirs one dollar. Item, I give and bequeath unto Clement Termans Heirs one dollar. Item, I give and bequeath unto my Daughter Letty Butler one dollar. Item, I give and bequeath to my Daughter Nancy Walthall one dollar. I give and bequeath to my Daughter Elizabeth Pacton one dollar. Item, I give and bequeath to my Daughter Patsey Pacton one dollar. Item I give and bequeath to my son George Terman one dollar. Item, I give and bequeath unto my son Christopher Terman one dollar. Item, I give and bequeath unto my son Leonard Terman one dollar. Item, I give and bequeath unto my beloved wife Rebecca the land I now live on and one negro boy named Matterson and all the rest of my perishable property that will be in her possession at my decease. Also, all the rest of my property remaining which is land, one lot lying in Franklin County and two lots lying in Elbert County. It is my wish and desire that these three lots of land lying in Elbert and Franklin Counties shall be sold and all my just debts paid out of the money arising from the three tracts of land before mentioned. And the balance of the money arising from the sales of the above land to be appropriated to the schooling of my two sons, James M. Terman and Jeptha J. Terman and all the above property that I have given to my beloved wife Rebecca Terman is to be for her use until my two sons, James M. Terman and Jeptha J. Terman shall become of age and then it is to be equally divided between her and my two sons abovementioned. I do hereby nominate and appoint Andrew Brown my Executor and Rebecca Terman Executrix, my sole executors for me in this my last Will and Testament, disannulling all wills heretofore my me made hoping that they may be spared to see it truly executed. Banks - and being duly sworn saith that they saw Martin Turman sign the within Will and Testament and at the time thereof believe he was of sound & disposing mind & memory and that he did it freely without compulsion to the best of their knowledge. /s/ Thomas (his X mark) Preston, James Rusk, J. H. Banks. November 6, 1826, Job Smith C.C.O. Recorded this 8th day January 1827. Job Smith C.C.O. Additional Comments: Martin Turman (b. ca. 1735-1740) m. (in Virginia) (1st) Ann Herndon (b. abt. 1739 in (probably) Caroline Co., Va.; d. aft. July 18, 1803 and bef. Oct. 1805 Elbert Co., GA. They were living in Mecklenburg Co., Va. (at least thorugh 1784) before coming to Georgia where they are found in Wilkes Co. by 1790. The land Martin owned in Wilkes Co. fell into Elbert Co. when that county was formed. All of Martin's children are mentioned in his will. Only the two youngest, James M. and Jeptha J., are by his (2nd) wife, Rebecca (maiden name believed to be White) to whom he was married after July 18, 1803 (1st wife, Ann, still alive) and by Oct. 22, 1805 (at which time Rebecca released her dower right to the sale of 300 acres in Elbert Co. from Martin Turman of Elbert Co., Ga. to James Coleman of Edgefield Co., SC. During the third or 1820 Land Lottery of Georgia, Martin Tureman drew draws in Walton (250 acres) and Appling (490 acres) counties. He was listed as living in Franklin County, Davis Militia District, at the time of the draw. Martin bought 125 acres in Walton Co., Ga. in 1821. Walton County, Georgia, Deed Book F (1825-1827), p. 171: On June 25, 1821, Martin Turman deeded this 125 acres in Walton County, Lot 85, to his wife, Rebecca Turman, in consideration of $50, for the term of her natural life and then the titles to be reverted to her two youngest sons James M. Turman and Jeptha J. Turman "against me, my heirs, Executors and ministrators." Thus clearly protecting this land from any possible legal dispute amongst his surviving children. This deed was recorded October 5, 1825 and was witnessed by Wilson White and Azariah Doss, J.P. Son James M. Turman died intestate in Walton County, Georgia. His estate sale was dated November 10, 1835. Son Jeptha J. Turman m. in Walton Co. on DEc. 28, 1841 to Mary Ann Preston. He moved from Walton to Cobb to Gwinnett to Walker Co., Ga. and died in Walker Co. in 1903. He is buried at Fowler Cemetery in neighboring Floyd Co., Ga. I will take this opportunity to also state that Martin Turman was not a son of James Turman(1752 Orange Co., Va.-1804 Franklin Co., Ga.) and Martha (Seals) Turman of Franklin Co., Ga. Information published many years ago listed Martin Turman as their son. The compiler of years ago, for example, did not realize that the Martin Turman who married Rebecca in ca. 1804-1805 was, in fact, the same Martin Turman who had been married to Ann Herndon. Martin was a contemporary in age with James Turman. In addition, no information has been found to date to link Martin Turman (or his brothers George and Thomas) who all lived in the Lunenburg/Mecklenburg Co. area of Virginia before coming to Georgia to the Turmans whom came from the Orange Co. area in Virginia and settled in Franklin Co., Ga.
