Jones Walton Court of Ordinary August - Term 1867 Came into open court at this regular term of the court - Bessy Summerson, John Edwards and Joseph E. H. McLaughlin, who being duly sworn depose and say that they saw Henry Jones Senior sign and publish the within, as his last will and testament while of sound and disposing mind; that they witnessed the same for him at his request, and in his presence, and in presence of each other; and that the same was executed voluntarily by him, on the day it purports to have been executed. Sworn to and scribed before me in open court August 5 1867 Jesse Mitchell Ordinary Berry Summerson John Edwards J. E. H. McLaughlin --------------------------------------- Henry Jones Sr. Georgia, Walton County - in the name of God, Amen. I, Henry Jones Senior of the County of Walton and State of Georgia, being of sound and disposing mind and memory and being desious to settle my little worldy affars while I have strength so to do make and publish this my last will and testament hereby revoking all wills by me at any time heretofore made and first, commit my Soul to god who gave it, and my body I desire to be buried in the Common family burial ground and my worldy estate I dispose of as follows (1st) My daughter Sarah T. Briscoe, I will give her five dollars, my Son John U. Jones I will give five dollars, my Son James D. Jones five dollars, my daughter Mary Churchill five dollars, my daughter Lydia A. Jones I will give her and to her airs (100) [unreadable] acres of land of the value three hundred dollars, my daughter Martha A. Patton, I will leave her fifty (50) acres of land value (200) two hundred dollars, my daughter Elizabeth Churchill I will give her (and children) (200) two hundred dollars wich will be in land 50 acres the rest of my land left wich will be about fifty acres moore or less I will give to the children of my three sons Henry and A. B. Jones and Mathias A. Jones to be equally divided between them to be taken joining there present to [unreadable]. My little stock consisting is horse mules cows and hogs and work steers cart all the farming tools blacksmith tools and I will give to my daughter Lidia Ann Jones and my son Henry Jones to not be disturbed till after my wifes and my daughter deceased or marriage none of the foregoing will be disturbed till after my own and my wifes deceased my present wife Sarah Jones. I now feel that justice is done to all of my children. I now opoint my son, Henry, executor, leaving my son Henry Jones to parcel of the lands and other property these lands will imbrace land lot number 26 and 43 the forth Dist of Walton County and State of (Ga) in witness whereof, the said Henry Jones Sr. to this my will consisting of the foregoing one sheat of paper have set my hand and seal this June 21st the 1867. Berry Summerson John Edwards Joseph E. H. McLaughlin --------------------------------------- Georgia, Walton County - To the court of Ordinary of said county- The petition of Henry Jones respectfully [unreadable] that Henry Jones Senior departed this life in said county on the 22 day of June last being at the time of his death a resident and citizen of said county; that said Henry Jones Senior left a will duty executed under the laws of this State. Therein conveying by desire and bequest real and personal estate of the probable value of one thousand dollars; that your petitioner is a son of said decedent, a legatee under said will, and the executor nominated therein - wherefore he proformed said will for probate in common form and prays that you proof thereof the same may be admitted to record in common form. August Term 1867 Henry Jones Jr. Court of Ordinary Walton County August Term 1867 The paper writing proformed for probate in common form as the last will and testament of Henry Jones Senior, late of said county decd having been duly proven before the oath of Berry Summerson, John Edwards and Joseph E. H. McLaughlin subscribing witnesses thereto - is ordered by the Court that said will be admitted to record as satisfactorily proven to be the last will and testament of said Henry Jones Senior in common form and that the executor Henry Jones Jr. have leave to qualify that letters testamentary issue to him before mistaking the usual oath - therefore came Henry Jones Jr. and duly qualified as executor of Henry Jones Senior and letters testamentary issued accordingly.
