IN THE NAME OF GOD, AMEN I Archelaus Flewellin, of the State of Georgia, Warren County, being through Divine Mercy in my ordinary state of health, and in the full exercise of all the powers of Mind and Memory, duly considering the shortness and uncertainty of this transitory life & the certainty of Death, have conceived it to be my duty to make some disposition of the property which it has pleased the Almighty to bless me with in this life, do demise and dispose of the same, in the following manner and form; that is to say, I give and bequeath to my beloved Son James Flewellin, Six Negroes, Viz. Sealy, Munford, Eaton, Mariah, Jacob, Matilda and Julia, one bed and furniture, three cows, & calves, One Yoke of Oxen, two Sows and Pigs, One Horse, Saddle, and Bridle, Nicholson's American Edition of the encyclopedia, and the sum of five Hundred Dollars, exclusive of what he has heretofore received of me. The above named negroes, Horse Saddle and Bridle, Bed, Cattle, Hogs &C being now in his Possession. I give and bequeath to my beloved son, Thoms Flewellin, Six Negroes, Viz. Reddick, Moses, Claiborn, Delilah, Hailey, and Fran; one yoke of Oxen, two Cows and Calves, one Steer, and Bed and furniture; One horse, Saddle & Bridle, and the sum of four dollars; exclusive of what he has received of me heretofore. I give and bequeath to my Grandson Thomas Flewellin Persons, to be received by him when he arrives at the age of Twenty one years Six Negroes, (which are now in the possession of his father Thomas Persons) Viz. Edy, Henry, Milberry, Asa, Sam & Hannah; one Sorrel Horse, Saddle and Bridle, one Bed and furniture, One Trunk and some other furniture; all of which property was lent by me, to his mother Cibell Flewellin, at her marriage, and is now in possession of his father Thomas Persons. Subject nevertheless to the following restrictions and limitations. Viz. If my said grandson, Thomas Flewellin Persons should decease before he arrives at the age of twenty one years, then, and in that case the above mentioned Horse, furniture &c. to be and remain the property of his father Thomas Persons and his Heirs, at his disposal: But the Negroes, Viz. Milberry, Asa, Sam'l & Hannah, Edy & Henry then to revert to and become part of my estate, and be equally divided between my other children or their legal Representatives, in the same manner as they had never been loaned, To my beloved Daughter Martha, I give and bequeath Seven Negroes Viz. Tho., Penny and her child Delilah, Little Winney, Alfred, Lucinda and Peggy; one Bay mare, a saddle & Bridle, one Bed and furniture, One trunk; Two cows and calves, and one Dripping Table. To my loving wife, Nancy Flewellin, and my three youngest children Viz. Enos Russell Flewellin, Lawrence Augustus Flewellin and Mary Ann Flewellin, I give & bequeath the following Negroes, Viz. Nancy, Sylvia, Hardy, Osburn, Harmon, Luke, David, Joe, Mourning, Winney, Chaney, Cynthia, Patsy, Charlotte, Epsey, Mary, Olive, Celia, Harriet, Morgan, Elijah, Enoch, Lacy, Ishum & Rosetta, & their increases together with my live stock of horses, cattle Sheep & Hogs, House- Hold & Kitchen furniture, Plantation Tools, Cotton Gin, Wagon or Wagons, &c. and the Proceeds of the crop now growing, except so much of the stock, crop &c. as may be found necessary for the purpose of discharging my just debts &c. for the payment of any Legacies or bequest herein before made; which I wish to be sold out of those things not already bequeathed, which my Executors at their discretion may think can best be spared (the negroes always excepted) and if any balance remain, together with the residue of the property mentioned in the foregoing Item, be kept together for the support of my said wife and the said three youngest children, until my Son Enos R. Flewellin arrives at the age of Twenty One Years, or until the decease or marriage of my said wife Nancy, which ever may first happen, and in case of either event, it is my Will that a division of the aforesaid property, so afar as respects my son Enos, do take place , and the remainder be kept together, until my youngest son Lawrence A. shall arrive at the age of Twenty one years, or until the marriage of my daughter Mary Ann, which ever may first happen; then a like division in their part or take place. My will and desire is, That my wife and my three youngest children above named do hold and occupy my lands, whereon I now live, containing about Six hundred aces, (be this same more or less) with covey the appurtenances, during the Natural Life or widowhood of my said wife Nancy; allowing and reserving to my two sons Enos R. Flewellin & Lawrence A. Flewellin an equal participation with each other in profit thence arising, after the said Enos and Lawrence shall respectively arrive at the age of twenty one years. And at the decease or intermarriage of my said Wife Nancy, I give and bequeath to my said two sons, Enos. R. Flewellin and Lawrence A. Flewellin, the lands wheron I now live; containing six hundred acres, (be the same more or less) with ---- appurtenances; to be as equally divided between them as can conveniently be done; having respect to Quality, convenience, improvements &c. to them, their heirs & assignees forever; They paying to their Sister Mary Ann; the sum of Two hundred Dollars each, within one year after my son Lawrence A. Flewellin shall arrive at the age of twenty one years. In case of the future intermarriage of my said beloved wife Nancy she is nevertheless to keep, hold and retain in her own absolute --- right, and at her disposal, the following property, Viz. of the negroes, Hardy, Nancy and her child Herman, Silvia and her child Osborn, and one fourth part of the Stock of Horses, Cattle, Sheep & Hogs, and one forth part of the Household and Kitchen furniture, which may be then remaining of my estate. It is my Will and desire, That in case of the death of any or either of my two youngest sons, Enos R. or Lawrence A., or of my daughter Mary Ann, before the sons arrive at the age of Twenty one years, or marry and have issue; or if my said daughter should die before she is eighteen years of age, or marry, in either of these cases, that the part or share of such deceased Legatee, revert to & become a part of my Estate, and be equally divided among all my own children, Viz. James, Thomas, Martha, Enos Russell; Lawrence Augustus and Mary Ann Flewellin, and their legal representatives. And in case of the death of my said wife Nancy without intermarriage, the part or share herein before bequeathed to her, to be freely & absolutely at her own disposal, to give, demise and bequeath the same to whom, and in such manner as her own Will and discretion may direct. Lastly, I do hereby nominate, Ordain & appoint my beloved Sons James Flewellin and Thomas Flewellin, and the Honorable Dennis L. Ryan, Executors of this my Last Will & Testament, Disannulling, Disallowing and setting aside all and every other Will or Wills, Testament or Testaments, by me heretofore made: Ratifying & confirming this & this only as my last Will and Testament. In Testimony whereof I the said Archelaus Flewellin, hath hereunto subscribed my name, and affixed my Seal, this Thirteenth day of June, in the year of Our Lord one Thousand eight Hundred and Twenty One, and in the 45th of American Independence.
