First It is my will & pleasure that all my just debts be paid as Soon as the Curcumstances of my Estate may Conveniently admit. My will & pleasure is that after my debts is paid that all my Estate both real and personal be kept together in the Hands of My Beloved wife Elizabeth Cody for the purpose of raising Maintaining and schooling my children or during her life or widowhood or until the youngest child becomes of age but if any of the children marry and she thinks proper to give them any at the property she can do so by having the property valued by three respectable men them giving her a receipt for the same but the Sum given is not to injure the rest of my family but what she can conveniently Spare so that my Estate hereafter may be equally divided but if my Wife should marry or die before the youngest child becomes of age my Will and pleasure is that all my Estate both real and personal be sold at a public sale giving twelve months credit and equally divided among my wife & children (that is to say) wife Elizabeth Cody, Edmond Cody Benjamin Cody Robert Cody Celia Cody Elias Cody Christopher C. Cody Catherine Cody Anelizar Cody Lucretia Cody and James Cody I constitute & appoint Barnett Cody & George W. Hardaway my Executors to carry into effect this my Last Will & Testament to the best of their ability and understanding In testimony whereof I have in the presence of three respectable person whose names are Subscrib'd, as Witnesses Sign and Seald & acknowledge the same this Second day of November in the year one thousand eight hundred & twenty five 1825. (His mark) Wit: Michael Cody (His mark), Danl Dennis, Peter Cody At an adjourn'd Court Sitting for Ordinary purposes Appear'd before Court Daniell Dennis & Peter Cody two of the Subcribing Witnesses and being duly Sworn saith that they saw the within Nam'd James Cody the Testator sign Seal publish & pronounce the within Instrument of writing as his Last Will & Testament and that at the time of his so doing he was in their opinion of Sound & disposing memory that they saw Michael Cody the other Subscribing witness sign his name thereto and that in the presence of each other & in the presence of the Testator and at his request they all become witnesses thereto So help you God.
