I John McCormick of the county aforesaid do make & ordain this my Last Will & Testament in manner & form following: To God I commend by soul and my Body to the Earth in desent Burial-and as reflects my Temporal Matters, I give first to my beloved wife Sarah McCormick after all my just Debts are paid all that part of the tract of land whereon I now live which lies upon the South Side of the Lane beginning near the Mill and running up the lane past the Mansion House and the well then a due South Course to Kinseys line with priviledge to cut and use all necessary timber upon any Woodland I now own. One Negro woman named Dolly and her Husband Jacob and a woman named Kitty. One first choice horse & Riding Carriage one half of all my stock of every kind besides a cart & steers The whole of my House furniture & Kitchen ditto (except the Secratary) One half of the plantation tools to have & to hold forever provided she shall not give sell or otherwise convey any part or the whole of the same to any person or persons except my own children or grandchildren and giving her the priviledge of making any advantageous trade with any live stock left Her. Second} I give my Son James McCormick his heirs & assigning forever on tract of land in Irwin County containing four Hundred & ninety acres, number eighty two in the Thirteenth District with Three hundred dollars cash to be paid within two years after my Death. Third} I give my Daughter Susanna Duckworth fifty dollars to be paid within two years after my decease and Fourth} I give my son Paul McCormick the balance of my Torrence Survey of land which lies on the South Side of the lane and all the unsold ballance of the Bearden Survey to have & to hold forever. Fifth} I give my Daughter Scena Cody all the Land on the Northside of the lane belonging to the Torrence Survey to have & to hold forever. Sixth} I give my Grandchildren Sons & Daughters of Polly Cody (to wit) Sarah Ann, Abner, Green, Mary, Scena & Michael Cody one negro woman named Jane with her increase to have & to hold forever Provided the said negro woman may remain in the possession and Service of my Daughter Polly Cody during her natural life and that my Executors shall have priviledge to debar the said negro woman from being taken by any person out of the County before she is Subject to distribution among y aforesaid Grand children. Seventh} I give to be equally divided share & share alike between my Sons Paul McCormick and Abner H. McCormick & my Daughter Scena Cody all the ballance of my Estate whither of goods chattells rights credits lands or tenements amongst which is one tract of land in the nineteenth District Wilkinson County, number one hundred & six Lot number two hundred & thirty seven in the thirteenth District Early County number ninety two in the tenth District of Early County with four negroes (to wit) Tom Rachel Daniel and Isaac except one tract of land number eighty seven in the Thirtieth District Lee County, which I give to George McCormick alias George Kitchen Son of Sarah Kitchen. Thereby nominate & appoint my wife Sarah McCormick my Son Paul McCormick &n Barnett Cody Executrix & Executors of this my Last Will &n Testament Revoking all other wills made by me. In testimony whereof I have hereunto set my hand & seal the twenty second day of January eighteen hundred & twenty Eight. Appear'd in Court Thomas Gibson, William P Butt and John Reynolds who being duly Sworn on Holy Evangelist Depose & say that they saw John McCormick the Testator within nam'd sign (by making his mark) pronounce publish & declare the within instrument of writing as his last Will & TEstament & at the time of his so doing he was further opinion & belief) of Sound mind & desposing memory & that in the presence of the testator & at his request they all became witnesses thereunto So help you God Thomas Gibson, William P Butt, John Reynolds Attest: T.
