Evans Complainant's Solicitor Filed January 1, 1821 Extract from Bill of Complaint: South Carolina Cheraw District To the Honorable, the Judges of the Court of Equity of the said State _____________(left blank). Humbly complaining show unto your honors, your orators, John Barwick, William Barwick, Stephen Barwick and Redding Barwick who is an infant and sues by his next friend John Barwick that their father, William Barwick, at the time of his death was seized and possessed in his own demeans as often of a considerable real estate, a schedule containing a description whereof is here with filed and marked A, to which your Orators beg leave to refer as often as may be necessary, on the case, and being so seized and possessed departed this life on or about the ____ day of ____ in the year of our Lord one thousand and eight hundred and seven, first duly made and executed his last Will and testament a copy whereof is here with filed and marked B, to where your orators beg leave to refer as often as may be necessary, by which said last Will and testament, your orators said father bequeathed to his wife the whole of his land to be equally divided between his seven youngest sons, to wit, your orators, John Barwick, William Barwick, Stephen Barwick, and Redding Barwick and Noel Barwick, Samuel Barwick and Eli Barwick, which said Eli Barwick has departed this life intestate and without having any wife or lineal descendents. And your orators further show unto your Honors that the widow of their said father has recently departed this life, and your orators are advised that the said lands now belongs to them and the said Noel and Samuel Barwick as tenants in common or joint tenants, their respective shares of the said land in severally have applied to the said Noel and Samuel confederating with diverse persons unknown have utterly refused to comply with these reasonable requests under various excuses and pretexts in and under consideration whereof, and for as much as your orators cannot compell the said Noel and Samuel to make partition of the said land but in this Honorable Court. To the end therefore that the said Noel and Samuel may produce and perfect answers make to all and singular promises as amply as of the same was herein agsain set down and they interrogated thereto. May it please your Honors to grant to your orators a writ of Subpoena directed to the said Noel and Samuel requiring them to appear before your Honors to answer to the promises, to stand to abide and perform such decree as your Honors shall see fit and propose to make, and that your orators may have a writ to be directed to certain Commissioners authorizing and requiring them to divide said land, pursuant to the last Will and testament of their deceased father, and they will ever pray. Commissioners Report dated April l, 1822. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -- - - - - William Barwick's Will of August 31, 1807 His wife to keep the whole of his estate, real and personal during her life and for her to be sole manager of the same, at her death, the whole to be divided between the seven sons. Proved by affidavits of James Hearon, John Register, and James Griffith, and is sworn to before John Mixon, J.P. This record can be found (1972) in an unrelated file cabinet in the Ordinary's Office, marked as "Adm.Est. 36-E Ordinary 1807-1816 and some in 1822". - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - William Barwick Sr. had received 640 acres in Darlington District, South Carolina for his Revolutionary Service. Another document shows 250 acres but one is his son who also served in the Revolutionary War. They both served from Dobbs County, North Carolina in Newbern District, North Carolina. Both documents are located in Treasurer's and Comptroller's Papers, Revolutionary Pay Vouchers, Department of Archives and History, Raleigh, North Carolina. One is Voucher No. 268 with the last name spelled Berwick and is dated July 3, 1786, the other is Voucher No. 223 dated June 29, 1784 with the name spelled Barwick. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Elizabeth Phillips Barwick, wife of William Barwick Sr. is last shown on the 1820 Darlington District, South Carolina census. She died the latter part of that same year as evidenced from copy of the Equity Court record above.
