Georgia Written: April 26, 1917 Georgia, Washington County, I, James F. Brooks of the County and State aforesaid being of sound and disposing mind and memory do make and publish this my last will and testament, hereby revoking any other wills I may have previously made. Item I - I will and bequeath to my beloved wife, Virginia Brooks, all my personal property and also all of my real estate. The real estate to be hers during her life and at her death to be disposed of as hereinafter provided. Item II - It is my will and desire and I hereby direct that after my death and the death of my wife that my real estate shall be divided as follows: That tract of land containing Seventy Five (75) acres, more or less, on the East side of said tract and above the line which I have already established and that tract of land below the Brooks Spring property containing One Hundred (100) acres, more or less, I give and bequeath to the grand daughter of my wife, Mrs. Neva Avant Tanner, to be hers for and during her life and at her death to such children or representatives of children as shall then be living, per stirpes. Item III - I will and bequeath after my death and after the death of my wife to my nephew, Luther L. Brooks, that tract of land West side of the line which I have established containing One Hundred and Twenty Five (125) acres, more or less. Item IV - My nephew, Luther L. Brooks and my grand daughter, Neva A. Tanner are charged with the care and support of my wife for the remainder of her life and should they neglect her or fail to properly provide for her they shall forfeit all interest under my will and my wife shall have the right to dispose of said property as she sees fit. Item V - I nominate and appoint as executor of this my will, my nephew Luther L. Brooks and direct that he shall pay my just debts as soon as practicable after my death and shall receive for his services no compensation and he is relieved from making any returns or having an inventory of my estate made.
