P 447] [all spelling, capitalization and punctuation transcribed verbatim] State of Georgia} Washington County} In the name of God, Amen I Joseph Daniel of said State and County, being of advanced age and knowing that I must depart this life, and wishing to make a disposition of the worldly property which a kind Providence has blessed, do therefore make this my last Will and testament, hereby revoking all others heretofore made by me Item 1st I desire and direct that my body be buried in a decent and Christian like manner, My Soul I trust shall return to God by whom it was created Item 2nd I desire and direct that all my just debts be paid by my Executor hereafter named Item 3 I give and bequeath and devise to my beloved Wife Elizabeth N Daniel, all my right and title to three hundred and fifty acres of land more or less in the County and State aforesaid on Sand Hill Creek. the place and premises whereon Jarred Wood formerly lived also three negroes to wit Ann a woman about eighteen years of age and her infant child and Jane a Girl about nine years old, and their increase. two Horses of the value of Seventy five Dollars each, three cows and calves one yoke of oxen and cart twenty five head of stock Hogs twelve head of sheep Six plows and two sets of gens One thousand pounds of Pork One hundred Bushels of corn two stacks of Fodder three feather beds bedsteads and furniture two tables six chairs,. half my kitchen and table furniture one brass clock and one hundred pounds each of sugar and Coffee and one wheel and pair of cards Item 4th I give and bequeath and devise to my Daughter Mary Jane Gilbert and all her children free from the disposition of her present or any future Husband my negroe woman Writ or Writters, about twenty five years of age. Juoy child of Writters about four years of age, Judy child of Writters about three years old and Reuben about thirteen years of age and all their increase forever. all of which negroes with the exception of Reuben I have already loaned to her also one feather bed bedstead and furniture one spinning wheel and pair of cards, and I hereby appoint my son Sampson Daniel trustee of the property herein given to my Daughter Mary Jane Gilbert and all her children Item 5 I give and bequeath to my son Sampson Daniel my negroe boye Sam about seventeen years of age for ever, which negroe boye has already been in the the possession of him the said Sampson Item 6 I give and bequeath to my two Grand Children George Lee Mason and James Daniel Mason, children of my Daughter Nancy Mason deceased, my negroe boye Russell about eighteen years of age, and my negroe boye child Martin about ten months old one feather bed bedstead and furniture which is to be equally divided among them, and if either of them should die before they come of age, the survivor to have the whole, and if both should die before they shall become of age then the property hereby devised to them to return to my children and be equally divided among them share and share alike in the same manner and under the same restriction that I have left their other portions or legacies. which properly I leave in the hands of their Father John F Mason who is to act as their natural Guardian during their minority Item 7 I give and bequeath to my Daughter Sarah Elizabeth Daniel and her children free from the disposition of any Husband she may marry, my negroe girl Annie about twelve years of age and her increase and my negroe boy George about ten years of age, one feather bed bedstead and furniture two cows and calves one spinning wheel and pair of cards, And if my said Daughter should marry then and in that event I do hereby appoint my son Sampson Daniel trustee to the property hereby given to her and her children. Item 8 I give and bequeath to my son Silas L Daniel my negroe boye Little Green about fifteen years of age one tract of land known as the Horton land containing eight hundred acres more or less adjoining Drury Gilbert and others to him and his heirs forever Item 9 I give and bequeath and devise to my son Jasper Newton Daniel my negroe boye Allen about fourteen years of age one tract of land in said County containing seven hundred and thirty four acres whereon I now reside known as the Scoggins and Warden place, one Horse bridle and saddle two cows and calves two Sows and piggs to him and heirs forever Item 10th My will and desire is that all the remaining portion of my Estate both real and personal not already disposed of be equally divided among all my children Viz Mary Jane Gilbert, Moses Daniel Sampson Daniel Silas L Daniel Sarah Elizabeth, Jasper Newton Daniel and my two grand children George Lee Mason and James Daniel Mason, children of my Daugher Nancy Mason deceased share and share alike with the exception of my two grand children the said George Lee and James Daniel Mason who shall receive only one seventh part of my said Estate not otherwise disposed of all the portion their mother would been entitled to if she was now living that portion going to my daughters to go in their possession in the same manner and under the same restrictions as their portions bequeathed to them in the fourth and seventh Items of this my last Will and testament.
