Kanaday of the County of White of the first part, and T.W. Tate of the County of Lumpkin of the second part. WITNESSETH: That the said party of the first part, for and in consideration of the sum of Two Thousand (2,000.00) DOLLARS in hand paid at and before the sealing and delivery of these presents, the receipt whereof, is hereby acknowledged, had granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell and convey unto the said party of the second part his heirs and assigns, all that tract or parcel of land lying and being in the first district containing seventy acres more or less it being all of A.G. Kanaday land except 3.33 left off of East Side beginning at a conditional back corner at the creek thence North a Strate line to the original line at rock corner thence west the original to a rock corner thence west with J.P. Smith line down to branch thence a strait line to the creek thence up the creek to the beginning corner the creek being the line, this deal is made for certain conditions of theirs until deth this is to take afect when they are ded. (ALL, from WITNESSETH; ABOVE WRITTEN IN HAND, pencil.) To Have and to Hold the said bargained premises, together with all and singular the rights, members and appurtenances thereof, to the same being, belonging or in anywise appertaining, to the only proper use, benefit and behoof of T.W. Tate the said party of the second part, his heirs and assigns forever, in FEE SIMPLE. And the said party of the first part, for there(hand written) heirs, executors and administrators, will warrant and forever defend the right and title to the above described property unto the said party of the second part, there(hand written) heirs and assigns, against the lawful claims of all persons whomsoever.
