Image is of poor quality: State of Georgia} Wilkes County} This indenture made this Eleventh day of January Eighteen hundred and Thirty Eight between Francis Coley, Administrator de bonis now with the Will annexed of John Owens Dec’d [Will was not copied with the Deed] of the one part and Welcome Fanning of the other part, both of the County and State aforesaid, Witnesseth that whereas the said Francis Colley Adm’r. . . did in obedience to an order of the Honorable Inferior Court of said County sitting for Ordinary. . . did advertise by public advertisement to sell the lands and premises herein. . . described, And in pursuance of said Order did advertise of the same for sale at the Court House in said County on the First Tuesday in December 1837 when and where the said Fanning became the purchaser at and for the price of five hundred and fifty five dollars, his being the biggest and last bid of record for the same. Now for and in consideration of the said sum of money to me in hand paid, I Francis Colley Administrator as aforesaid have bargained & sold and by these presents doth grant, bargain, sell and convey unto the said Welcome Fanning his heirs and assigns all that tract or parcel of Land situate, lying and being in said State & County on the waters of Fishing Creek containing two hundred acres more or less adjoining George Bailey, deceased, Cox’s Land, Burdette’s Land and others, the same known as the Owens old place. Also all that tract or parcel of land in said County adjoining the above tract containing Seventy acres more or less, And also all that Tract or Parcel of Land lying in said State and County on the Waters of Fishing Creek adjoining A.L. Alexander, E.L. Bolton, containing one hundred and four(?) acres more or less, The said three tracts or parcels of land being the real estate of said Deceased, To have and to hold the same to the said Welcome Fanning his heirs and assigns together with all and singular rights, members & appurtenances to the same belonging or in any way appertaining, And I the said Francis Colley Adm’r as aforesaid. . . will warrant and forever defend unto the said Welcome Fanning. . . The deed pertains to land formerly owned by John Owens who is the father of Frances Owens who is the wife of Francis Colley. Francis Colley became the administrator of his mother-in-law’s estate. This deed describes the same property as in the deed recorded in NNN, page 233, above. Image is of poor quality: State of Georgia} Wilkes County} This indenture made 11th day of January Eighteen Thirty Eight between Welcome Fanning of the first part and Francis Colley of the other part, both of said State and County, Witnesseth that the said Welcome Fanning [brother-in-law of Francis Colley] for and in consideration of the sum of Five Hundred and Fifty Five dollars to him in hand paid & before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, hath granted, sold and by these presents doth grant bargain sell and convey unto the said Francis Colley his heirs and assigns all these Three tracts or parcels of land, situate lying & being in the County of Wilkes and State aforesaid, on the Waters of Fishing Creek, Three hundred and seventy four acres more or less, all together being the same tracts or parcels of land sold by Francis Colley, Administrator “de bonis” of John Owens Dec’d [father of Francis Owens, who is wife of Francis Colley] on the first Tuesday in this instant [month] at public Sale at the Court House in said County & purchased by said Fanning at said Sale, Together with all and singular the rights members & appurtenances to the same belonging or in any way appertaining, To have and to hold the said Land and members to said Francis Colley his heirs and assigns forever. And I the said Fanning [warrant] the tract of land aforesaid composed of said three tracts as aforesaid, will warrant and forever defend unto the said Francis Colley his heirs and assigns against the claims of myself my heirs and assigns and against the claims of all other persons whatsoever.
